I, John Tally, being in perfect mind and memory as usual, but knowing it is appointed for all men to die, do make and ordain this my last will and testament as follows: Imprimis: I will that my boddy be decently buried by my executors hereafter named and as to worldly property of which I am possessed, I do entirely except my first wife's children and will that my Executors pay them $3 each - James, Winniford, Frances Ann, Catherine, John, and George Washington, totaling $18. Item. To my beloved wife, Margarette, after just debts and funeral expenses are paid, one-third part of the estate and one-fifth part of my personal property. Item. Balance to be divided between my youngest children, William, Nathan, Elizabeth, Jane and Nancy. If any of them die without issue, their part is to be equally divided amongst the surviving children of my last wife, Margarette. Executrix My living wife Margarette, and Executor my friend (hard to read). Witnesses Eleazer Anderson Alexander McPherson Thomas Talley Additional Information: Per Montgomery County Marriage Book C, page 73, John Talley married Margaret Carr on September 4th, 1828, married by A. Hatley, JP. The marriage license was issued on August 26th 1828. Per Montgomery County Marriage Book E, page 304, Margaret Talley married William W. Supple on November 28, 1845, married by G. W. Jeter, MG. The license was issued on November 27, 1845. The following are given as some help. These may or may not be the children of John Tally/Talley: A Frances Ann Tally married Lovick Stewart on December 19, 1833, per Marriage Book D, page 83, Montgomery County, married by Walter Boyd, JP. A James Tally married Dorcus Jones on December 23, 1836, per Marriage Book 1, page 172, Lowndes County, Alabama, married by Zacheus His, MG A Winifred Talley married John E. C. Lewis on March 24, 1842 per Marriage Book 1, page 426, Lowndes County, Alabama, married by H. M. Todd, MG.
