Will of Joseph Love/Lane, Sr. - Morgan Co., AL In the name of God, amen- I Joseph Love Sen'r of Morgan County State of Alabama being of sound mind and memory do make publish and deliver this my last will and Testament in the words and form following (to wit) Item 1st/ I give and bequeath to my daughter Jane _?_igh one hundred dollars to her and her heirs forever. Item 2nd/ I give and bequeath to my son Jesse A. Love my quarter section of land on which I now live with all the improvements thereon to him and his heirs forever, reserving to my beloved wife Phebe Love her dower in said land Item 3rd/ I give also to my son Jesse A. Love one bed and furniture, one horse worth one hundred dollars to him and his heirs forever, -- Item 4th/ I give to my beloved wife Pherebe Love all my household and kitchen furniture except that I have already disposed of -- Item 5th/ It is my will and desire that my river tract of land shall be sold by my executor at public sale and the proceeds of said sale applied to the paying out and patenting the tract of land on which I now live -- Item 6th/ It is my will and desire that all my other property of what kind soever after paying all my just debts shall be equally divided between my beloved wife Pherobee Love, my daughter Pherebee Love, my daughter Rebecca Love and son Jesse A Love except that the value of the property heretofore given to my wife Pherebee Love is to be taken from her share in this division. That's the line I've been researching for awhile. I don't want to be too long-winded nor disrespectful, because I'm very glad to see the will in total - however, I believe there is one grave error - the below abstract will show you that we believe the name of this person to be LANE, not LOVE. Will bk A-203 Joseph Lane (b. 8 Apr 1761 d. 29 Nov 1825) LWT 20 may 1825, probated 2 Feb 1826 names dau. Jane High w/o Robt. A. High, son Jesse Lane, wife Pereba Hunter Lane (b. 25 Jun 1765 d 11 Sep 1826), dau. Rebecca Lane, dau. Delia BURT (b. 14 Dec 1785), son Isaac Lane, dau. Patsy BURT (b. 20 Nov 1789), son Joseph Lane, son Jonathon Lane. Sons Joseph and Jonathon Lane, execs. George Darwin, Joseph Lane, Jr. & John Davis, Wit. There are multiple census records and other documents that list this entire family as LANE. They came originally from Halifax Co., NC. If you have the original will or copy thereof, you might want to take another look - that old handwriting is VERY difficult to make out at times. Jno. BURT - and dau. Jane m. R.A. HIGH] Burt, John 1 male 5-10 2 males 10-15 1 male 40-50 1 female 10-15 1 female 15-20 1 female 40-50 [Check: Capt. Jno. BURT b. ca 1780 age 50 in 1830; wife Delia (LANE) b. 1785, age 45 in 1830 - also listed in the 1850 census - son Joseph b. ca 1817 age 13 in 1830; son Henry b. ca 1820 age 10; if John L. son, b. ca 1821 age 9; son (if William H.) b. ca 1822, age 8; apparently some daus. Too. This family matches except for one son. The sons assumed are families from the 1850 Morgan Co. census. One or more could be sons of Hardy or James BURT.
