The State of Alabama,County of Morgon,August
18,1840.: I Thomas Hubbard Sr.of said county
now of sound mind and memory,but being,old and infirm,do make and ordain and publish
my last will and testament as follows,and herby revoke all former will's
whatsoever,towit.
Item 1st..Having sold my land and megroes, retaining possesion of the land and
certain negroes during my life,I hereby give and
bequeath unto Vincent Hubbard,David Hubbard, Stephen Hubbard,and James Hubbard,my
four son's in equal parts all of my property of every decription whatever.House hold
and kitchen furniture,stock,crops,farming untensils,debts due,and money on hand at
the time of my death.ITEM 2nd;I herby appoint my son,David Hubbard as executor of
this my last will and testament,whose duty it shall be to collect and distribute my
estate in confirmity with my said will by selling all of the property at public sale
for cash, giving one months public notice of the time
and place of the sale and out of the proceeds shall if demanded,pay to Green K.
Hubbard,Thomas Hubbard,Elizabeth Wilson, Margaret Hewlett and Catherine Morris,one
silver dollar each and nothing more,and the residium of the proceeds,shall be
divided 
according to the provisions of the first item in this will between the said
Vincent,
David,Stephen and James,and if one or more of them should then not be living my said
Executor shall pay their respective legacies to the living children of such as may
be dead previous to the distribution herein contemplated.I give to Cynthia
Calledonia
Hubbard my largest bed as a specific legacy with the furniture thereunto
belonging,and I give to Laura Emily Hubbard my remaining bed and furniture also a
specific legacy to be set apart before my property is inventoried
for the puropse of sale.Wittness my hand and seal this nineteenth day of August in
the year eighteen hundred and forty in presense
of W.C.Roberts,M.K.Murphy,H.M.Cauthers. Signed Thomas Hubbard { seal}.
      

Additional Comments:
All of these children mentioned in the will,David,Stephen,James,Vincent,Thomas Jr.,
Greene Kirk,Elizabeth Wilson,Margaret Hewlett,Catherine Morris are Thomas
Sr.children.There must have been a falling out f sorts with Thomas & some of his
children and grandchildre.Among them my Gr-Gr-Grandmother Margaret Hewlett & Her two
children,Mary Catherine & William Alexander Hewlett.Thomas Mortimer is my 3rd.Gr-
Grandfather. Calldonia & Emily are thought to be granddaughters.
