Morgan Botaus@aol.com October 3, 2009, 7:21 pm Source: Will Book A Pg. 273 Written: February 12, 1851 Recorded: June 25, 1852 Recorded in Perry Co., AL in Will Book A, page 273 STATE OF ALABAMA PERRY COUNTY I, David Hay, being of sound mind and disposing memory but being advanced in age in view of the uncertainty of life do make and declare this my last will and testament in manner and form following towit: 1st: I resign myself to the will of Almighty God and my body to the Tomb to be buried as my Executors shall (see) fit an proper and my Estate both real and personal to be disposed of as follows towit 2nd I will that all my just debts be paid out of my effects 3rd I give and bequeath to my beloved wife Winneford Hay all the land with the appertainances thereto which I now own to have to hold during her natural life or widowhood. I also give to my said wife the following Negro slaves named Fed and Gin, Randal and Tiller, Frank and Andy, Fillis and Vilet and Catharine also all my stock of all kinds all my farming utensils household and kitchen furniture to have to hold the same during her natural life or widowhood. 4th It is my will that my two sons, William J. Hay and David Willis Pope Hay do stay with their mother my wife and take good care of her so during her natural life or widowhood and to have a just and full reward for their attentions and good performance yearly and in case she should marry it is my will that she my wife do have one third of the land and three of the best horses to have during her natural life until the end of the year. 5th It is my will at the death of my wife that the land left her be valued by a disinterested committee of three persons and equally divided between my two sons William J. Hay and David W.P. Hay and the valuation to be a portion of their distributive shares each to them the land for them to have and to hold forever in fee simple and the negroes (and) other property to be valued and equally divided amongst or between all my children and if it cannot be divided equal between them in that way it shall be sold by my Executors and the Effects of the sale divided Equal between all my children. 6th I give and bequeath unto my daughter Mary Sutton now deceased one negro boy named Abram and after the death (of) me and my wife I give and bequeath to the Heirs of Mary and John Sutton one negro woman named Catharine to be equally divided to them. 7th I give and bequeath unto daughter Penninah J. Hopkins one negro boy named Felix and girl named Rosse. 8th I give and bequeath to my daughter Elizabeth Muse *(married 27 December 1821) two negro boys named Blandy and Harry. 9th I give and bequeath unto my son Wm J. Hay one negro girl and boy named Clary and Squire 10th I give and bequeath to my daughter Malinda A. Hopkins a negro girl and boy named Trease and Mager 11th I give and bequeath to my daughter Gressy A. Edmunds one negro boy and girl named Bedford and Dinah *(Guzzell and James daughter?) 12th I give and bequeath unto my daughter Sarah A. Heard *(married 1832) one negro girl and boy named Mary and Dallas 13th I give and bequeath to daughter Haska B. Griffin one negro boy and girl named Burrel and Ann 14th I give and bequeath to my daughter Cordelia Goocher two negro boys named Jack and Dick 15th I give and bequeath to my daughter Martha McDimard two negro girls named Viney and Malinda 16th I give and bequeath to my daughter Winneford A. Hay two negro girls named Sucky and Mandy 17th I give and bequeath to my son David W.P. Hay two negroes named Lewis and ________(blank) 18th I do hereby appoint my two sons William J. Hay and David W.P. Hay to execute this my last will and testament. Signed, sealed and publicly declared by the said testator as his last will and testament in presence of us on this the 12th day of February A.D. 1851 David Hay Wit: Bird Griffin Thos. B. Wallis Thomas Fletcher In the name of the benevolent father of all I David Hay of the County of Perry and State of Alabama to make a cotestament will. Since it have the will of kind providence to take my beloved wife from the stage of action before me it becomes necessary for me to revoke and change one or two clauses of my will made and provided before her death. Viz: the clause that provides for her to have and to hold the land and negroes her lifetime. 1st It is now my will that William J. Hay and D.W. Hay my two sons do take charge and keep the negroes left to my beloved wife during her natural life all together until my debts are paid also all the stock of all kinds household and kitchen furniture 2nd It is my will that William J. Hay shall keep the negroes and stock and all pertaining for the years one thousand eight hundred and fifty-two to make a crop for himself to remunerate him for his two years service with me that is to say for the year 1850 and the year 1851, this the 7th day of October A.D. 1851 Signed, seale(d) in the presence of John Milford John Hay Bird Griffin Zeno Phillips Ordered June 25th, 1852 James F.
