I Andrew J. Stewart of the County and State aforesaid being of sound mind and memory and considering the uncertainty of this frail and transitory life do therefore make ordain publish and declare this to be my last will and testament. I give and bequeath to my beloved wife ______ Stewart my present Homestead known ____ designated as the North 1/2 of the E 1/2 of the _____ of section No 17 and the SE 1/4 _____ NE 1/4 of Section No 17. and the NE 1/4 of E 1/4 of the ?same? section all in Township No ___ Range No 9 in said County and the ____ __ ___ belonging, to have and to hold for sole use and benifit during her natural life and at her death the same to descend to my son Garrett Stewart. 2nd . I give and bequeath to my son Garrett Stewart my mule Rhody, my gold watch my plantation wagon an bed and furniture and an cow named Stan and her calf, them and their increase, said wagon and said cow and calf and their increase to remain in the family so long as my said son Garrett and his mother both live. 3rd. I give and bequeath to my beloved wife the balance of my stock of cattle to have and to hold during her natural life, and at her death them and their increase to be equally divided between these daughters Margaret Martin Elizabeth J Hughes and Mary Frances Ivey. 4th. I give and bequeath to my said wife all my stock of hogs and goats my horse Reb all my farming tools and the balance of my Household and Kitchen furniture during her natural life and for my son Garrott also to have and to use and benefit of the same as long as he continues to remain with his said mother and at her death the property bequeathed in this 4th Item to be equally divided between my four children Garrett Stewart Margaret Martin Elizabeth J Hughs and Mary Francis Ivy. 5th. I make constitute and appoint my said son Garret Stewart Executor to this my last will and testament hereby revoking all former wills by ___ made. Bolling State of Alabama Perry County Probate Court Special Term Dec 22nd 1871 The probate of the last will and testament of A.J. Stewart dec'd Before me A. C. Hinze a Judge of Probate formally appeared Florilla Tomblinson and Benjamin F. Bolling two of the subscribing witnesses to the paper proported? as the last will and testament of A.J. Stuart , dec'd who being by me first duly sworn to speak the truth the whole and nothing but the truth depose and say that A.J. Stewart executed the paper proporoted? as his last will and testament on the day of the date thereof in their presence: that they attested said instrument in the presence of said testator and at his request on the day of the date thereof __ further say that at the time ___ said will said testator was of sound ____ and memory and fully capable of ___ said will that he was then a re-___ of Perry County Alabama and over __age of twenty one years, and that never ___ influence the executor of said will as for ___ him in balance, and that said A.J.
