Johnson mikenmk@bully.net http://www.geocities.com/athens/thebes/8287/ "The Whittens of Winston County, Mississippi" --------------------------------------------------------------- PICKENS COUNTY 12 Apr 1848 -- Shepherd Spencer to Caroline Whitten and Wm Hudson: Deed of Gift -- Pickens County, Alabama: Shepherd Spencer gave to granddaughter Caroline Whitten of Winston County, Mississippi and her children one negro girl, Hulda, per these conditions: 1) the girl must be managed by whom he appoints for the use of his granddaughter, 2) the girl and her services cannot be held liable for debts or contracts made by Caroline or her husband, 3) the girl’s services may be disposed of at the discretion of the appointed men during Caroline’s life and after her death, Hulda and her children shall be equally divided between Caroline’s children. William Hudson and Austin Whitten are nominated to carry out the purposes of the gift. They can take Hulda into their possession at any time to dispose of her at their discretion. Recorded 14 Apr 1847 in Pickens Couny, AL Book K-409. Deed was received in Winston County, MS 27 Sep 1848 and recorded 1 Dec 1848 in Bk K, Pg 127. 9 Oct 1846 -- Shepherd Spencer, Sr. to Hannah E. Whitten: Deed of Gift Pickens County, Alabama: Shepherd Spencer, Sr. gave granddaughter Hannah E. Whitten of Winston County, Mississippi one negro woman, Milbry and her children Whitnel and Amanda per these conditions: 1) the negroes must be managed by whom he appoints for the use of his granddaughter, 2) neither they nor their services can be held liable for debts or contracts made by Hannah her husband, 3) the services of these negroes may be disposed of at the discretion of the appointed men during Hannah’s life and after her death, Milbry and her children shall be equally divided between Hannah’s children. William and Lemuel Hudson were nominated as trustees of the gift. They could take Milbry and her children into their possession at any time to dispose of them at their discretion. Recorded in Pickens County, AL 27 Oct 1846 in Book P-150. Deed was received in Winston County, MS 27 Sep 1848 and recorded 4 Dec 1848 in Bk K, Pg 129. 8 Feb 1849 -- Shepherd Spencer to Caroline Whitten: Deed of Gift Carolton, Pickens County, Alabama: Shepherd Spencer gave to granddaughter Caroline Whitten of Winston County, Mississippi one negro boy named Joseph, aged 6 yrs per these conditions: 1) the boy must be managed by whom he appoints for the use of his granddaughter, 2) the boy and his services cannot be held liable for debts or contracts made by Caroline or her husband, 3) the boy’s services may be disposed of at the discretion of the appointed men during Caroline’s life and after her death, Joseph and his children shall be equally divided between Caroline’s children. Robert S. Hudson was appointed trustee of the gift. Recorded in Pickens County, AL 8 Feb 1849. Received in Winston County, MS 21 Feb 1849 and recorded 13 Mar 1849 Bk K, Pg 193. 8 Feb 1849 -- Shepherd Spencer to Nancy Ann Terry: Deed of Gift Pickens County, Alabama: Shepherd Spencer gave to granddaughter Nancy Ann Terry of Winston County, Mississippi one negro woman Milly and her two children Jerry and Hasselline per these conditions: 1) the negroes must be managed by whom he appoints for the use of his granddaughter, 2) neither they nor their services can be held liable for debts or contracts made by Nancy or the trustees, 3) the negroes’ services may be disposed of at the discretion of the appointed men during Nancy’s life, and if she were to die without issue, then the negroes shall be divided between Mary Narine, Caroline Whitten, Hannah E. Whitten, James Spencer, and Lucinda Spencer. Robert S. Hudson appointed trustee. Given in Pickens County, AL 8 Feb 1849. Received in Winston County, MS 21 Feb 1849 and recorded 14 Mar 1849 Bk K, Pg 194. 21 Apr 1849 -- Shepherd Spencer to James Spencer: Deed of Gift Pickens County, Alabama: Shepherd Spencer gave grandson James Spencer [of Winston County, Mississippi?] one negro girl, 10 yrs old, named Hager per these conditions: 1) the girl must be managed by whom he appoints for the use of his granddaughter, 2) she and her services cannot be held liable for debts or contracts made by James or the trustees, 3) her services may be disposed of at the discretion of the appointed men during James’ life, and if he were to die without issue, then the negro and her children are to be divided between James’ sisters [names not given in deed]. Henry Low and William Moore of Oktibbeha County appointed as trustees. Lemuel Hudson was the witness. Given in Pickens County, AL 23 Apr 1849. Received in Winston County, MS 24 Dec 1849 and recorded 26 Jan 1850 Bk L, Pg 20. 18 Jun 1849 -- Shepherd Spencer to James Spencer: Deed of Gift Pickens County, Alabama: Shepherd Spencer gave grandson James Spencer [of Winston County, Mississippi] one negro girl, 9 yrs old, named Amanda per these conditions: 1) the girl must be managed by whom he appoints for the use of his granddaughter, 2) she and her services cannot be held liable for debts or contracts made by James or the trustees, 3) her services may be disposed of at the discretion of the appointed men during James’ life, and if he were to die without issue, then the negro and her children are to be divided between James’ sisters [names not given in deed]. Received in Winston County, MS 24 Dec 1849 and recorded 26 Jan 1850 in Bk L, Pg 21. ---------------- PICKENS AND SUMTER COUNTIES 22 Feb 1849 -- Shepherd Spencer to Lucinda Spencer: Deed of Gift Pickens County, Alabama: Shepherd Spencer gave to [unmarried] granddaughter Lucinda Spencer of Sumter County, Alabama, daughter of Wiley Spencer deceased: two negro boys Aaron and Bob per these conditions: 1) the negroes must be managed by whom he appoints for the use of his granddaughter, 2) neither they nor their services can be held liable for debts or contracts made by Lucinda or the trustees, 3) the negroes’ services may be disposed of at the discretion of the appointed men during Lucinda’s life, and if she were to die without issue, then the negroes shall be divided equally between the children of granddaughter Mary Narine [of Winston County, Mississippi?]. Dr. Robert W. Washington and John W. Narine were appointed trustees. Lemuel Hudson was the witness. Given in Pickens County, AL 22 Feb 1849. Recorded in Livingston, Alabama on 24 Jan 1850. Received in Winston County, MS 26 Feb 1850 and recorded on 1 Mar 1850 in Bk L, Pg 64. ------------------ SUMTER COUNTY 13 May 1843 -- Shepherd Spencer to Mary Ann Lowe: Deed of Gift Shepherd Spencer, Sr. of Sumter County Alabama to Mary Ann Lowe (formerly Mary Ann Hudson) of Oktibbeha County, Mississippi and Henry Lowe of Winston County, Mississippi. On 27 Dec. 1831, Spencer gave to Mary Ann Lowe (formerly Hudson) a negro woman named Hagar and children Jessee, Neely and Ned for the benefit and use of Mary and her children by her former husband James Hudson. However, Jesee and Nelly have died, but four have been born: Charles, Sam, Adar, and Cynthia. But now Mary has remarried to Henry Lowe, with his knowing that the negroes belonged to Mary and her children. Now Shepherd gives and releases to Mary all his title and interest in the negroes Hagar, and her children Edward, Charles, Sam, Adar, and Cynthia, to be divided upon Mary’s death between her children by her former husband per these conditions: 1) The negroes cannot be made liable for any debts contracted by Mr. Lowe, and if Mr. Lowe refuses to comply, the negroes will revert back to Shepherd or his executors for disposal to benefit Mary and her children. Also, Mr. Lowe and his heirs release all claims to the above negroes. Given 13 May 1843. Received in Winston County, MS 6 Feb 1854 and recorded 10 Feb 1854 in Bk N, Pg 61.
