Willis C. Wood Judge of the said Court: The petition of Janies (James) D. McEachern as Guardian of the persons & property of John J. A., William C. & Hasseltine McEachern, minors - who is full age and resident of said County, respectfully represents unto your Honor that William C. Anderson who is over twenty-one years of age of sound mind and resides in Pike County, Alabama. John J. A. McEachern who is under twenty-one years of age, & over 14- of sound mind and resides in Pike County Alabama with petitioner William C. McEachern who is petitioner. Hasseltine McEachern who is under twenty-one years of age, & over 14- of sound mind and resides in Pike County Alabama with petitioner whose guardian Petitioner, their father. Ora Anderson who is under twenty-one years of age under 14 & of sound mind and resides in Pike County Alabama with her mother Mary Anderson & Mackie Anderson who is under 14 years old & resides in Pike County with Mary Anderson his mother the last then named minors have us legal guardian are the joint owners of the following described property, situated in this County, to wit: NC 1/4 of SE 1/4 & SW 1/4 of SE 14. Section 29 T 9 R 22 lying in Pike County, Alabama. Said parties are interested as follows to wit: Wm. C. Anderson, one third; John J. A., Wm. C. Hasseltine McEachern one third and Ora, Carrie & Mackie Anderson one third. That said property cannot be equitably partitioned or divided without a sale of the same and that would be the interest of all said parties & especially said minors to sell said land for the purpose of partition and division. Your petitioner therefore prays your Honor, to decree the said property to be sold for said purpose and to make and issue all such orders as maybe necessary to effect said thereof. Wood, Judge of Probate Court in and for Pike County, State of Alabama 1. That she is a citizen of said county and state over 21 years old and femi sole. 2. That she is the relict and widow of James Anderson, deceased, late of said County, whose Estate is under administration in your Honor's Court by William C. Anderson of said County, who is the Administrator thereof. 3. That the following named persons and they alone are the heirs and distributes of said estate, to wit: your petitioner as above stated and William C. Anderson, administrator as aforesaid about 42 years old and heirs of Hasseltine J. McEachern dec'd to wit: Johnie McEachern about 10 years old, Willis McEachern about 8 years old, Hasseltine McEachern about 6 years old, the heirs of James Y. Anderson deceased, to wit: Ora B. Anderson about 8 years old, Carrie J. Anderson about 6 years old, Mackie Anderson about 4 years old; all of whom reside in this County. The heirs of Hasseltine J. McEachern reside with their father J. D. McEachern. The heirs of James Y. Anderson reside with their mother Mary J. Anderson. 4. That said decedent died interstate, seized and possessed of the following described land, situated in said County, to wit: The NE 1/4 of SE 1/4 and the SW 1/4 of SE 1/4 Section 29 Township 9 Range 22- 80 acres more or less, which is the homestead and the place where decedent died worth about $400.00 * (on the side of petition is * Also the following described personal property to wit: 1 mule, 1 old buggy, 3 cows & yearlings, 1 lot of books, 1 old with 1 set of plow gear & plow tools, 5 or 6 head of hogs & household & Kitchen furniture all worth about Two Hundred dollars.) 5. Your petitioner further shows and avows, that she, as widow as aforesaid, is entitled to realty not exceeding One Hundred and Sixty acres, and in not more than Five Hundred Dollars to include homestead of said Estate, as exempt from the administration thereof, under the Acts of the Legislature 18871 & 2- Acts of .71 & 2 page 19 or 2. 6. That said decedent departed this life on or about 20th day of October 1871, interstate - and that letters were granted and issued to said administrator, on the 8th day of October 1872, less than thirty days from this date. 7. In consideration of the premises & that petitioner may have the relief and land, to which she is entitled under the law & this petition makes the aforesaid heirs & administrators, parties hereto and asks that they have notice, if necessary, of the same. And may it please your Honor, upon hearing, to grant this petition - appoint three appraisers in accordance with said Act and that said land be set off to her as required by said act & allotted as she having elected to take or have said homestead or five hundred dollars worth, as contemplated by said act in lieu of the money as there stated. And to that end and that the same may in all things be accomplished in accordance with the law in such cases made: Your petitioner further prays that such orders and decrees maybe made such process issued and served, and all such other proceedings had in the premises as may be proper & requisite to give off & complete the title in said land to your petitioner & as in duty bound & c. Wood, Judge of the Court of Probate in & for the Pike County, State of Alabama: The petition of Sarah Anderson respectfully showeth unto your Honor, that she is the widow of James Anderson, deceased, whose estate is now being administrated in this Court by William C. Anderson, as the Administrator thereof. Your petitioner further state the following named person and they alone are the heirs and distributes of said Estate, to wit: your petitioner, widow as aforesaid, William C. Anderson over 21 resides in Pike County Alabama, the heirs of Hasseltine J. McEachern, dec'd, to wit: Johnie McEachern about ten years old, Willie McEachern about 8 years old, Hasseltine McEachern, about 6 years old and the heirs of James G. (Y.?) Anderson dec'd, to wit: Ora B. Anderson about 8 years old, Mackie Anderson about 4 years old. The heirs of Hasseltine J. McEachern reside in this County with their father J. D. McEachern. The heirs of James Y. Anderson, dec'd reside in this county with their mother Mary J. Anderson. Your petitioner further represents unto you Honor, that said James Anderson deceased, died, seized and possessed of the following described land, situate in this County, to wit: The NE 1/4 of SE 1/4 and the SW 1/4 of SE 1/4 Section 29 Township 9 Range 22- 80 acres more or less. Your petitioner further shows, that she is entitled to have selected and set off to her, by metes and bounds, Five Hundred Dollars worth of the above described land, to include the homestead, or such portion of the same as can be selected without injury to the remaining portion of the estate. That she is entitled to the same under Section 2061 of the Revised Code of Alabama. Your petitioner avows that said Estate is insolvent and that it would be necessary to all (sell?) the lands to pay the debts against said Estate and cost and expenses of administration. Your petitioner therefore prays your Honor to grant this Petition and appoint appraisers to set apart said Five Hundred Dollars worth of land as required by law, and make all such orders and decrees and issue such process as maybe necessary in the premises. Petition for 500$ worth of land ----- Filed in office October 16th 1872 & Granted Judge of Probate Page 194 Report of Appraisers. The State of Ala.} Pike County} To the Hon. Willis C. Wood, Judge of the Probate in and for said County: We, the undersigned Appraisers, appointed by your Honor on the 16th day of October, 1872, to select, appraise, and set off Five Hundred lying said county, described as follows, to wit: The NE 1/4 of SE 1/4 and the SW 1/4 of SE 1/4 Section 29 Township 9 Range 22- 80 acres containing Eighty acres, (more or less,) for the use of Sarah (Jane is crossed out and Sarah written above) Anderson, widow of deceased, to hold forever: We, the said appraisers - after being duly sworn - proceeded, on the 26 day of October 1872, to, and did, select, appraise, and set off and apart, Five Hundred Dollars worth of said lands above described, to the said Sarah Anderson, widow of Deceased, as follows, to wit: The NE 1/4 of SE 1/4 and the SW 1/4 of SE 1/4 Section 29 Township 9 Range 22 and appraised by us at the value of Five hundred Dollars. We therefore hereby appraise and set off same to the widow aforesaid, under the provision of subdivision 6 of section 2061 of the Revised Code of Alabama, and put her in possession of the same, all of which is respectfully submitted.
