Wills, 1844-1863 Alabama Probate Court Microfilm of original records at the Pike County courthouse, Troy Alabama Submitted by: Chere Lee Page 237-238 The State of Alabama Pike County In the name of God Amen I John Clark of said county being of sound mind and memory and considering the uncertainity of this frail and transitory life do therefore make ordain publish and declare this to be my last will and testament, that is to say after my funeral expenses and all other of my lawful debts are paid and discharged the residue of my estate real and personal I devise and bequest as follows to wit, To James Clark __ my half interest in the hereafter __ Land the West 1/2 half of the NW 1/4 of NW 1/4 of Section 22 and West half of SW 1/4 of SW 1/4 of Section 15 and all of that part of the NE 1/4 of the SE 1/4 of section 16 lying East of Conecuh River and the NE 1/4 of NE 1/4 of Section 21 and the NW 1/4 of SW 1/4 of Section 15 in Township 11, of Range 22 containing one hundred and forty acres more or less also the following notes to wit, Two on Emanuel Ritch each one for four hundred and twenty five dollars given D. 15th 1857 and due 25 Dec. 1860 and 1861 also two notes given by David Williams one for fifty dollars and the other for forty four dolars and fifty cts. given June the 7th 1859 and due the 25th Dec. 1859 also one land warranty for acres No. 13581 also my nigra woman Moley and all my cattle and hogs. I likewise make constitute and appoint James Clark to be Executor of this my last will and testament hereby revoking all former will be me made. Given under my hand and seal this Oct. 14, 1861 John Clark his mark Signed sealed published and declared by the said John Clark as said for his last will and testament in the presence of us who at the request pf the said John Clark and in his presence have hereunto to subscribed our names and respective places of residence as witnesses. The State of Alabama Pike County Probate Court of said county In the matter of the Probate of the last Will & Testament of John Clark deceased Before me Bird Fitzpatrick Judge of the said Court personally appeared in open court Jere Babcock and Jacob H. Stowe who having been by me first respectfully duly sworn & examined, did and do depose and say on oath that they are subscribing witnesses to the instrument of writing now shown to them & which purports to be the last Will & Testament of John Clark deceased late an inhabitant of said county; that said Clark since deceased signed & executed said instrument on the day the same bears date and declared the same to be his last Will & Testament and that appiants set their signatures whereto on the day the same bears date as subscribed witnesses to the same in the presence of said Testator that said Testator was of sound mind & disposing memory & in the opinion of deponent fully capable of making his will at the time the same was so mde as aforesaid appiants further state that said Testator was on the date of the said will of the full age of twenty one years & upwards Sworn to & Subscribed before Jery Babcock me in open Court J.H.
