F. Harmon, of the State of Alabama, and the County of Pike, in view of the uncertainty of life, and being of sound and disposing mind and memory, do hereby make and publish this my last will and testament, in words as follows:- First:- I hereby constitute and appoint my wife, Nancy Harmon to be sole executrix of this my last will, directing my said executrix to pay all of my just debts out of my estate, and she shall not be required to give bond as such executrix. Second:- The whole of my estate, after my just debts have been paid, I hereby give and bequeath to my said wife Nancy Harmon, including all of my real and personal property of every description whatever with full power to sell and dispose of the same in any manner whatever that she may see fit to do, upon the condition that if my wife shall die intestate then all of the property that she may own or be possessed of, whether real estate or personal property, remaining of my estate or proceeds of my estate herein bequeathed and given to her, of whatever form or manner of property it may be in at the time of her death, shall be equally divided into four parts among the following named persons: (1/4) One-fourth to my son Alonzo Harmon, (1/4) to my son Charles Edward Harmon, (1/4) one-fourth to the children then living of my son T. B. Harmon, to be divided equally among said children, and (1/4) one-forth to my son R. L. Harmon as trustree, without bond, for my deceased son's daughter Gussie Harmon, if the said Gussie Harmon be then alive, said amount, or so much of it as he may deem necessary to be used or expended in the support of the said Gussie Harmon remaining unexpended in the hands of the said R. L. Harmon as such Trustee shall be delivered by him to my daughter Annie Ham, the wife of B. A. Ham, to be received by the said Annie Ham in some measure of compensation for caring for and raising the said Gussie. Third:- It is my wish and desire that my said wife Nancy Harmon shall consult and advise with our son R. L. Harmon about and concerning all contracts that she may desire to make, and in all things concerning the management or disposition of any part of my said estate herein bequeathed to her, and that in all such matters she act upon and be governed by his advice. Mauk (His signature) Additional Comments: PETITION FOR PROBATE OF WILL The State of Alabama, ] Probate Court Pike County. ] Petition of Nancy Harmon for the Probate of the Will of John F. Harmon deceased. To the Hon. W. J. Williard, Judge Probate Court, Pike County; The Petition of the undersigned Nancy Harmon who was at the time of his death an inhabitant of this County, departed this life at his home near Orion, Ala., on or about the 10th day of August 1897, leaving assets in this State, and leaving a Last Will and Testament duly signed and published by him and attested by John Gamble, Jr., and W. J. Mauk. That your petitioner, as she believes, is named in the said will as Executrix and sole legatee and does now here with surrender said Will to the Court, and pray that after proper proceedings and proofs, it may be probated and admitted to record as the true last Will and Testament of said deceased. Your petitioner futher represents that she, Nancy Harmon is the widow of said deceased, and that the names, ages, residence and condition of the next of kin are as follows, to-wit: T.B.Harmon,R.L., Alonzo, & C.E.Harmon, all children of Petitioner and said John F. Harmon, all over 21 years old and reside in Pike County,Ala. Annie J. Ham, who resides at Patsburg in Crenshaw County, Ala. and Mary _ McCullough, who resides in Montgomery County,Ala. who are each children of said John F. Harmon & Petitioner and over 21 years old. Gussie Harmon, a minor under 14 years old, daughter of J.F. Harmon, Jr.,deceased, in the custody of the above named Annie Ham - Minnie Moody who resides in Crenshaw County,Ala. is the mother of said Gussie Harmon. Also Mary Gertrude and Willie Lee Hause, minors over 14 years old & John T., Eugene and Eddie Hause, minors under 14 years old, children of Feddie Hause, deceased, who reside with their Father, W.S. Hause near Cameron Texas in Milam County - the said Feddie Hause & J.F. Harmon, Jr., deceased, & being children of said J.F.H. & Petitioner. Your Petitioner would futher represent that John Gamble, Jr. and W.J. Mauk, the said attesting witnesses reside in Troy, Pike County, Ala. and were competent witnesses to said will. and therefore your Petitioner futher prays that your Honor will give notice to the next of kin, above named, of the said John F. Harmon, deceased, in the manner prescribed by law, of the time of law of becoming his Petition and proving said will and upon final hearing others making proper proof admit said will to Probate and file and second same.
