J. F. Harmon, of the State of Alabama, and the County of Pike, in view of the uncertainty of life, and being of sound and disposing mind and memory, do hereby make and publish this my last will and testament, in words as follows:- First:- I hereby constitute and appoint my wife, nancy Harmon to be sole executrix of this my last will, directing my said executrix to pay all of my just debts out of my estate, and she shall not be required to give bond as such executrix. Second:- The whole of my estate, after my just debts have been paid, I hereby give and bequeath to my said wife Nancy Harmon, including all of my real and personal property of every description whatever with full power to sell and dispose of the same in any manner whatever that she may see fit to do, upon the condition that if my wife shall die intestate then all of the property that she may own or be possessed of, whether real estate or personal property, remaining of my estate or proceeds of my estate herein bequeathed and given to her, of whatever form or manner of property it may be in at the time of her death, shall be equally divided into four parts among the following named persons: (1/4) One-fourth to my son Alonzo Harmon, (1/4) to my son Charles Edward Harmon, (1/4) one-fourth to the children then living of my son T. B. Harmon, to be divided equally among said children, and (1/4) one-forth to my son R. L. Harmon as trustree, without bond, for my deceased son's daughter Gussie Harmon, if the said Gussie Harmon be then alive, said amount, or so much of it as he may deem necessary to be used or expended in the support of the said Gussie Harmon remaining unexpended in the hands of the said R. L. Harmon as such Trustee shall be delivered by him to my daughter Annie Ham, the wife of B. A. Ham, to be received by the said Annie Ham in some measure of compensation for caring for and raising the said Gussie. Third:- It is my wish and desire that my said wife Nancy Harmon shall consult and advise with our son R. L. Harmon about and concerning all contracts that she may desire to make, and in all things concerning the management or disposition of any part of my said estate herein bequeathed to her, and that in all such matters she act upon and be governed by his advice.
