I Jesse Pugh of the County of Pike in the State of Alabama,being of Sound mind and disposing memory,and in good heath but having attained an age,when I feel that it is wise to arrange my affairs in the world when I cannot in the order of nature continue to live a great while longer,do make and ordain this my last Will & Testament,hereby revoking all other wills which I have at any time make. First, I give to bequesth to my beloved wife Lydia the following Negros,Reuben,George & Huldah,also two hundred acrea of land being the East one half of the NW one fourth & the west one half of the NE one fourth &the S East one fourth of the NE one half of Section 14,T 10 & R 20,in the County of Pike aforesaid,also all my Household & Kitchen furnture Plantation tools,two mules and one horse,five cows & calves,four Sows & pigs and ten head of stock Cattle besides,five EWS,& Lambs,twelve Hundred pounds of pork,four hundred bushels of Corn,and one thousand weight of fodder,to be the property of my wife during her life subject to her absolute controlle,and upon her death to be sold & divided equally among my heirs named in this will. Second,I give & bequeath to my Son Mastin B. a Negro Girl Charity & a Negro Boy Nelson. third,I give & bequeath to my Daughter Malinda Stinson ,now a widow;Lucy a Negro woman & her child Silas Said Negros to be property of my daughter Malinda during her life,and after her decease to descend,to her children;and i hereby desire that in case Malinda should marry again,the same property is to be kept for her Sole & separate use during her life & immediately become the property of her children upon her death. Fourth I give & bequeath to my Son Burrell,Laner a Negro woman & her increase. Fifth I give & bequeath to the children of my deceased daughter Elizabeth,to wit,Jepe,Louis,John,Emeline,Rebecca,Lydia,Albert Dowering,& Betsey,a Sum of money out of my Estate,Equal in amount to the value of the property which my children taks under this will;that is they are to have in money a share of my Estate Equal to the share which their Mother would have recieved as one of my heirs,had she survived me. Sixth,I give & bequeath to the children my deceased daughter Polly Ann Wiggins,to wit,Lydia,Jane,Rhoda,Margaret,Martha,Jepe Harrison & Mastin the same amount of money equal on amount to the share which my other children are to receiv in property and which their mother my daughter Polly Ann,would have recieved had she survived me. Seventh,I give & bequeath to my Son Ira the following Negroes,Betsy,&a woman & Rose a Girl and their increase. Eighth,I give & bequeath to my Son Albert a Negro woman Letty & a negro Boy Isaac with their further increase of Letty. Ninth,I give & bequeath to my Son Louis a Negro Boy Henry & a negro girl Cynthia with her further increase. Tenth,I give & bequeath to my daughter,Adeline wife of Stephen Blackburn a Negro woman Easter & a negro Boy Fortune to be the property of my daughter,Adeline for her Sole & separate use free from the Control of her Hubsand & not in any way liable for his debts to be own property during her life & after her decease to descent to her children. Eleventh,I hereby will and direct that at my death my Negros named Bill &Dolly shall be Sold,and also that my land not herein named & bequeath and all other property not mentioned in this my will shall be Sold and that the money so raised shall be enployed to make up the sum to be paid to the children of my deceased daughters as i have above described and if there should be any overplus after paying over to my Grand Children the money there discribed to be paid to them,then said overplus shall be divided out among all my children so as to make the share they recieve of my Estate as nearly Equal as possible,my wish being that each of my Heirs should recieve as nearly as may be an Equal portion of my property that is my children living at the time of my death are to take the property which I have hereby bequeathed to them,and if they should die before I depart this life then the property which I have bequeathed to them to descend to their children or an amount of money Equal to said property to be paid to themas I have directed in the case of the children of my deceased daughters.
