Signed Crosby The State of Alabama, Randolph County, On this 29th day of March A.D. on thousand eight hundred and Fifty six, personally appeared before me, a justice of the peace, authorized to administer oaths for general purposes, within and for the County and State aforesaid Jeremiah Nix, aged 67 years, as resident of Randolph County, in the State of Alabama, who being duly sworn according to law, declares that his the indentical Jeremiah Nix, who was a Private in the company commanded by Captain Underwood in the (blank) regiment of Georgia Malitia, commanded by Col. Booth, in the war with Great Brittan for the term of 6 months, and continued in actual service in said war for fourteen days: that his has heretofore made application for bounty land under the act of September 28, 1850 and received a land warrant, No. 25.792 for 80 acres, which his has since legally disposed of, and cannot return. He makes this declaration for the purpose of obtaining the additional bounty land to which he may be entitled under the act approved the 3 day of May 1855. He also declares, that he has never applied for nor received, under this or any other act of Congress, any bounty-land warrant except the above mentioned Signed, Jeremiah Nix We William J. Given under my hand and Seal of office at office in Wedowee this 31st day of March 1856 Signed, Joseph Benton, Judge of Probate BOUNTY LAND CLAIM, Form of Declaration for Suviving Officer or Soldier State of Alabama, County of Randolph On this twenty ninth day of November A. D. one thousand eight hundred and fifty, personally appeared before me, a Justice of the Peace within and for the County, and State aforesaid, Jeremiah Nicks age sixty four years, a resident of Randolph County in the State of Alabama who being duly sworn according to law, declares, that his is the indentical Jeremiah Nicks who was a private in the Company commanded by Wm H. Underwood in the 4th Regiment of Infantry commanded by Col. D.S. Booth in the wat with Great Britain declared by the United States on the 18th day of June 1812. That he was drafted at Elbert County, Ga on or about the (blank) day of (blank) A.D. 1814 for the term of six months and continued in actual service in said war forthe term of six months and was honorably discharged at Fort Hawkins on about the 28th of April A.D. 1815. as will appear (blank) by the muster rolls of said company. and that his Captain nor other officer never gave him a certificate of discharge and that there is no person in this country living by whom he can prove his service that he knows of. He makes this declaration for the purpose of obtaining the bounty land to which he may be entitled under the "act of granting bounty land to certain officers and soldiers who have been engaged in the military of the United States", passed September 28th 1850. One thousand eight hundred and fifty five before me David A. Perryman the subscriber, a Justice of the Peace, duly authorized by law to administer oaths, within, and for the County and State aforesaid, personally appeared Jeremiah Nix age 66 years, a resident of Randolph County in the State of Alabama who being duly sworn according to law, declares that his is the indentical Jeremiah Nix who made application for Bounty Land under the provisions of the Act of Congress passed September 28th, 1850, and that a Bounty Land Warrant, No 25792 for 80 acres, was issued to him on the (blank) day of month unknown 1852 for the military services, set forth, and established by evidence now on file in the Pension Office at Washington, to which reference is made. Given my hand and seal of my office, at Chulafrinnee Ala, April 10 A.D. 1855 Signed, Francis M Perryman, Notary Public War of 1812 Declaration of a Widow for Pension State of Alabama County of Randolph On this 1st day of April, A.D. eighteen hundred and seventy-one personally appeared before me, R. H. Bolt, Clerk of the Circuit Court, a Court of Record in and for the County and State aforesaid, Francis Nix, age 76 years, a resident of the County of Randolph, State of Alabama, who being duly sworn according to law, declares that she is the widow of Jeremiah Nix who served the full period of sixty days in the (1) Infantry service of the United States in the War of 1812, and who was the identical Jeremiah Nix who (2) was a Private in Captain David Booth's Company, (blank), Regiment (blank) Brigade (blank), Division, at Ellenton, GA on the 30th day of October, 1814, and was honorably discharged at Savannah, Ga on the 30th of April 1815; that (3) he Jeremiah Nix applied for and received two Bounty Land Warrants for 80 acres each under the acts Set 28th 1850, and 3rd of March 1855 both of the number on not recollected. that she was married under the name of Francis Web to said Jeremiah Nix on the 20th day of December, A.D. 1810, by name not remembered or near Ellerton, Ga, there being no legal barrier to such marriage; that her said husband died in Randolph County Ala about 15th day of December 1857, and that she has not remarried since his death; that at no time during the late rebellion against authority of the United States did she or her said husband adhere to the cause of the enemies of the Government, giving them aid or comfort, or exercised the functions of any office whatever under any authority, or pretended authority, in hostility to the United States; that she will suppport the Constitution of the United States; that she is not in receipt of a pension under any previous act; that she make this declaration for the purpose of being placed on the pension rolls of the United States, under the provisions of the act approved February 14, 1871, and hereby constitutes and appoints, with full power of substitution and revocation Samuel V Niles of Washington DC her true and lawful attorney, to prosecute her claim, and obtain the pension certificate that may be issued; that her post office is at Wedowee, County of Randolph State of Alabama; that her domicile or place of abode is Seven Miles West of Wedowee Ala Signed, Francis (her mark) Nix Attest: J.A. Werrick, Examiner Report: Above Warrant issued to Jeremiah Nix fo service in Capt Underwood Co Ga Mil from 21st Nov 1814 till 6th May 1815 No evidence of marriage or death of soldier Signed, John Sheerman, Cheif B'ty L'd Div, Aug 24, 1871 AFFIDAVIT OF HIRAM McCLUNG, November 1, 1871 In the State of Alabama, Randolph County Personally appeared before me W. W. Dodson Judge of the Probate for said county and state the same being a court of record= Hiram McClung age 70 years who being duly sworn in times of the law deposeth and saith that he has for the last 50 or 55 years been well acquainted with Francis Nix the applicant for pension and with Jeremiah Nix her deceased husband and on his first acquantence (sic) with them they had som (sic) 3 or 4 children and from his best judgment by the family record and all other facts they have been married married some sixty two years that he never heard their marriage disputed that the lejetimacy (sic) of the same was not called in question and that I have no interest in this claim. Signed, Hiram McClung AFFIDAVIT OF AUSTIN NIX, November 1, 1871 Also Personally appeared Austin Nix age 56- a citizen of Randolph County Ala who being duly sworn in being of term Law deposeth and saith that he is a son of Jeremiah Nix Deceased and Francis Nix the applicant for Pension and that he has a brother and sister older than he is that his Fathers Record shows that his sister May White was born in 1812. an the 24 of Feb and that his parents had been married over a year and that the fact of them being legally married has never been called in question since he could reoled (sic) that they lived together and was reguarded as such up to the death of his Father = and that I have no interest in this claim Signed, Austin Nix AFFIDAVIT OF D. A. PERRYMAN, November 1, 1871 Also Personally appeared D. A. Perryman who being duly sworn in terms of the Law deposeth and Saith that he has been acquainted with Francis Nix for 24 years that they had grand children grown or nearly. So on his first Intimate acquaintence some 15 years ago = that he made application for Jeremiah Nix for a Bounty Land Warrant in 1855 and that Jeremiah Nix was there speak inf - of his campus as a Soldier and about his wife = and that he had live for some --- ?--- moved before he intener the service and that Austin Nix had been some 10 years last passed exempt from Road duty by ---?--- of Ap- that is by living above the age of 45 years, that he has a sister has all the time been said to be some 3 or 4 years older than he is= and that there are many records destroyed and believe this is the only means of proving the lejetimacy (sic) of tha marriage of said Jeremiah and Francis Nix and that I have no interest in this claim Signed, D. A. Perryman AFFIDAVIT OF W. COLWELL, Post Master, Wedowee, September 29, 1871 The State of Alabama, Randolph County I T.W. Colwell Post Master at Ala do hereby certify that after careful investigation I am convinced that J.A. McCreless and Wiley A. Nix who I am informed have testified on the Loyality of Francis Nix widow of Jeremiah Nix dec'd who was a soldier in the War of 1812 whose = application No 4060= are per ---?--- undoubted Good Character for truth and voracity and that their statements in the affidavit referred to are worthy and full faith and credit. Dated at Wedowee Ala this 29th day of Sept 1871 Given under my hand and offical stamp and signature W. Colwell, Post Master at Wedowee Randolph County Alabama DEPARTMENT OF INTERIOR, Pension Office, Washington D.C., January 3d 1872 To Sam'l V Niles, Esq. Washington D.C. Sir : In the claim of Francis Nix for a widows pension under the act of Feby 14th 1871. No 4060, it appears that there is a private record of the claimants marriage to the soldier - As this record is evidence of a higher character than the affidavits as to cohabitation offered and as the evidence now on the file does not clearly show that the parties were married prior to Feby 17th, 1815 the original record or a copy of it should be furnished - In case a copy of it forwarded the officer authenicating it should certify that he has confraved (?) the copy with the original and found it correct and that from its ancient appearance he believes the record to be genuine - Your attention is also called to the requirement of the enclosed circular that the higher classes of evidence must be accounted for before the lower classes can be accepted. Evidence by oath or affirmation of two or more witnesses acquainted with the fact is required as to the death of the soldier Please return this letter with the evidence, Very respectfully C. W. Lewton, Acting Commissioner AFFIDAVIT OF JAMES Y WHITE, February 22, 1872 The State of Alabama, County of Randolph Personally appeared before me W. W. Dodson Judge of the Court of Probate for the County and state aforesaid James T White as citizen of of Randolph County, Ala and a man of unquestionable character as to truth and voracity = who being duly sworn in terms of the Law deposeth and saith that he has been for 36 years last passed intimately acquainted with Francis Nix the applicant for Pensions who is the widow of Jeremiah Nix deceased and that his knew the said Jeremiah Nix up to his death that he the affiant(sic) saw him die and he died in two miles of Wedowee in Randolph County in the latter part of 1856- that he saw him after he was dead and has frequently seen his grave and has every since his death been intimately acquainted with the applicant Francis Nix and knew that she is still a widow and that since the death of the said Jeremiah Nix she Francis Nix has never ajain (sic) remarried that she has lived within 1/2 mile of affiant for 12 twelve years last passed and that is his means of positive knowledge in this case and that I have no interest in this claim Signed, James Y White AFFIDAVIT OF HIRAM McCLUNG, February 22, 1872 Also at the same time and place personally appeared before me W. W. Dodson Judge of Probate for the County of Randolph and State of Alabama Hiram McClung a citizen of Randolph County Alabama a man of good standing and of undoubted good character for truth and veracity who being duly sworn in terms of te Law deposeth and saith that he as been for forty years passed well acquainted with Francis Nix and was well acquainted with Jeremiah Nix her deceased husband up to his death and that to their best of his recollection he died in December 1856 that he was present saw him die and shaved him after death ---?--- and helped to bury him that he died within two miles of Wedowee in Randolph County Alabama and that his widow Francis Nix has every since his death remained a widow that he lives and has lived for 12 years last passed within two miles of Francis Nix and this is his means of knowledge of the facts above stated and that he is not interested in this claim nor its presecution Signed, Hiram McClung GEORGIA ELBERT COUNTY, Marriage License There are to authorize and permit you to join in the Honorable State of Matrimony Jeremiah Nix of the one part and Fanny Webb of the other part according to the rites of your church, provided there be on lawful court to obstruct the same, and this shall be your authority for so doing. W. A. Nix on RV from 4 Sept 1880 to 16 Sept 1880, Amt. $3.47 Very Respectfullly D. S. Boynton, Pension Agent Additional Comments: *** Note there is a descrepancy about the date of death of Jeremiah. The summary report of Samuel V Niles, attorney for Francis Nix, indicates that Jeremiah's death date was based on affidavit given by Hiram McClung as 15 Dec 1857, when actually Hiram McClung's affidavit says that Jeremiah died in Dec 1856.
