Teal Gravelle tealtree@comcast.net July 23, 2006, 1:08 am The Roanoke Leader February 1928 NEWSPAPER ABSTRACTS FROM "THE ROANOKE LEADER", Roanoke, Randolph County, Alabama for FEBRUARY 1928 NEWSPAPER Issue of Wednesday, February 1, 1928 BIRCHFIELD WILL BE PUT TO DEATH; Man Who Killed Howard Dudley Loses Appeal to Supreme Court Under decisions handed down by the Alabama Supreme Court yesterday, three condemned men, Johnnie Burchfield, Tobe Collins and Will Hudson, were started on their final journey to the tier of cells on the narrow corridor that leads into the death chamber at Kilby prison. Johnnie Birchfield was convicted in Chambers county of the murder of Howard Dudley, a school boy, who was lured from a school truck into a nearby woods where he was shot to death and his body thrown into a small creek, where it was found by searchers several days later. Tobe Collins was found guilty by a jury in the Mobile circuit court of stabbing Clarence Stewart to death. Will Hudson was convicted in Walker county for the shooting and killing of Tinsie Mae Jones. All three defendants were sentenced to pay the extreme penalty. The sentence of the court in the cases of Birchfield and Collins was death by hanging. Hudson was sentenced to death by electrocution. While appeals of Birchfield and Collins were pending, electrocution succeeded hanging as a method of inflicting the death penalty in Alabama. The Supreme Court, therefore, in affirming judgment of the trial courts, remanded these cases for re-sentence under the electrocution law. Affirming judgment int he case of Hudson, the high court fixed Friday, March 23rd as the date for his execution.
