Bryan estate James A. Scarborough Administrator of Thomas P. Bryan dec'd VS The heirs and distributes of said estate. Came this day James A. Scarborough, Administrator of the Estate of Thomas P. Bryan deceased, and filed this petition stating that the said Thomas P. Bryan died seized in his own right of the following Estate to wit: Section fourteen, Township fifteen and Range twenty eight, situated lying and being in the County of Russell and State of Alabama, and it further appearing to the Court that the following and the heirs and distributes of the said Intestate to wit: William H. Bryan, John F. Bryan, Mary Ann Scarborough, wife of James A. Scarborough, who are of full age and reside in the County of Russell and State of Alabama. Also Ann Dasher, wife of Jackson Dasher who resides out of the limits of this State and in the County of Lowndes in the state of Georgia, and Louisa M. Turner, formerly Louisa M. Bryan, wife of Lucian H. Turner who resides in the County of Macon and State of Alabama, both of whom are feme covert and of full ages. And also Malvina Bryan, who resides out of the limits of the State and in Stewart County in the State of Georgia, and Amanda Bryan who resides in County of Russell and State of Alabama, both of whom are minors. And it further appearing that the real estate of said intestate cannot be fairly equally, and beneficially divided among the heirs of said Intestate without a sale of the land. Whereupon, It is ordered by this court that publication be made in the Alabama Journal for forty days requiring the said William H. Bryan, John F. Bryan, Mary Ann Scarborough, Ann Dasher, and Louisa M. Turner who are heirs of full age to be and appear at an Orphan's Court to be held in and for said County of Russell on the first Monday in September next. And it is further ordered by the Court that O.G. O'Neal be appointed guardian ad litum for the minor heirs of said decedent, and that citation do issue to said guardian ad litum in terms of law and also to the said heirs and distributes who are of full age requiring them to appear at said Orphans Court then and there to show cause if any they may have why an order for the sale of the above described land should not be granted.
