Dawson & John C. Bacon, Executors of JOHN CROWELL, Sr. deceased VS The Heirs and Devisees of said Estate. Whereas heretofore to wit: on second day of November AD 1846, a petition was filed by John R. Dawson and John C. Bacon, Executors of the last will and testament of John Crowell Senior, deceased, setting forth that the said decedent died seized and possessed in fee simple of the following described land to wit: the West half of Section twenty-six, the North East quarter of Section thirty-five, the East half and NE quarter of Section thirty- four, and the East quarter of Section thirty four, all of Township Seventeen and Range Twenty-six, and North East quarter of Section three and all of East half and North West quarter of Township sixteen and Range Twenty six, lying and being in the County of Russell and State aforesaid; And the said petition further reciting that the above described Real Estate could not be beneficially divided among the heirs of said decedent without a sale of the above described Real Estate and it appearing by the petition so filed as aforesaid that Samuel C. Benton, Absalom Benton, Sarah Crowell, Ariadora Alexander, wife of William Alexander, Emma Whitaker, wife of James A. Whitaker, Evaline Belamy, wife of William Belamy, Mary (Jane?) Grant. Wife of McDonough Grant, Peggy Morton, wife of William Morton who are of full age and reside in the County of Russell. Elizabeth Leonard, wife of Alexander K. Leonard, Martha W. Wright, wife of Edward W. Wright, Peggy Bryan, wife of William Bryan who are of full age and reside out of the State of Alabama. Florida P. Crowell and Sarah T. Crowell, minors who reside in the County of Russell are the heirs of said decedent. And it appearing to the satisfaction of the Court that the necessary publication has been made to the heirs who are of full age and by citation in a public newspaper and that citations has been served on Samuel C. Benton, guardian ad litum for minor heirs requiring them to appear on the first Monday in March AD 1847, and contest said petition and now at this term of the Court, it appearing that there is no objection made why said order should not be granted and made final, it is therefore adjudged and decreed by the Court that John R. Dawson and John E. Bacon, Executors of John Crowell, Sr, deceased, have leave to sell the above described real estate at public out-cry to the highest bidder upon giving forty days notice of said sale by posting up notices in three public places in said County previous to said day of sale and by publication in one of the public Gazettes in this State for three consecutive weeks before said day of sale, and that the said Executors make return of said sale to this Court as required by law.
