The State of Alabama, Russell County In the name of God Amen. I Charles Baker, of the state and county aforesaid, being of sound mind memory and understanding, being aware of the uncertainty of life, and the certainty of death, and wishing to settle and dispose of all worldly affairs as far as possible whilst in this condition, do hereby make and ordain declare and publish this, to be my last Will and Testament, hereby revoking and declaring null and void all others heretofore made. After the payment of all my debts, I hereby charge my estate both real and personal with the following bequests: First—I give and bequeath to my beloved wife Celia Baker, one thousand dollars, which is to be paid to her, on relinquishment of her Dower in and to the real estate now possessed by me, and to be received in lieu thereof. Second—I have heretofore given and paid as a part of the share of Willis P. Baker my son, seven hundred dollars, ?? of my sons Richard P. Baker & Isaac Baker three hundred dollars, and to my son Charles Baker, Jr. the sum of eighteen hundred dollars, also to the heirs of my daughter Priscilla Vincent the sum of seven hundred dollars and to my daughters Mary McIntosh and Gilla (?) Byrd, three hundred dollars each, which said sums are to be deducted respectively from their share or portion of my estate, both real and personal and charged as assets of my said estate and deducted from their respective shares. Third.—I give and bequeath to my daughter Celia Baker, one bed and bedstead, one trunk and one cow and calf. Fourth—After the payment of the above and foregoing named bequests I hereby authorize, request and empower my hereinafter named Executors as early as it can be legally ordered to sell all my Estate, both real and personal and divide the proceeds of such sale equally between my wife Celia Baker, and the heirs of my daughter Priscilla Vincent, my sons Willis P. Baker, Richard P. Baker, Isaac Baker, Charles Baker, Jr., my daughters, Mary McIntosh, Rebecca Bogg, Gilla Byrd and Celia Baker after being charged with the payments heretofore made to them above written. Fifth.—I do further ordain that the portion of my estate given to my wife Celia Baker shall at her death be equally divided between all my children and the heirs of my deceased daughter Priscilla. Sixth—I hereby appoint my son Richard P. Baker as trustee for my son Willis P. Baker and direct that the interest of my said son Willis in my said estate be vested entirely in the hands of Richard P. Baker, in no wise to be subject to the control or to the payment of the contracts of Willis P. Baker. Lastly—I do hereby constitute and appoint my son Richard P. Baker and my son in law William Byrd to be Executors of this my last will and Testament and I herein require that my said Executors shall be entitled to charge one per cent as their compensation for administration upon my estate and no more, or one half per cent each. In witness whereof I have hereunto subscribed my name and affixed my seal on this third day of July, in the year of Our Lord, One Thousand Eight Hundred and Sixty One. Garlish The State of Alabama, Russell County Personally appeared in open court Edgar Garlich, Benjamin Doles and Peter F. Bugg, the subscribing witnesses to the foregoing will who after being sworn depose and say that Charles Baker the testator therein, voluntarily executed the same and declared the same to be and contain his last will & testament in their presence, on the day the same bears date; and that day signed their names as witnesses in his presence and in the presence of each other; and that in their opinion and belief said Testator at the time of executing said will was of sound and disposing mind and memory. Additional Comments: There is a very large Estate file for Charles Baker (over 120 pages). One of the papers in the file gives a list of the heirs of Charles Baker deceased: Celia Baker (widow) Russell Co. Willis P. Baker Louisiana Children of Priscilla Vinson (wife of John Vinson) a deceased sister: Willis Vinson, Charles Vinson, James Vinson, all of full age and the following minor children: Andrew Vinson, Mary Vinson, & Rebecca Vinson.
