I Eli Clark of said State and County being of advanced age and knowing that I must shortly depart from this world deem it right and proper that I should make some distribution of the property with which a kind Providence has blessed me. I therefore make this my last Will and testament, hereby revoking and annulling all others (heretofore made by me.) Item 1st I desire that my body be buried in a decent and Christian like manner suitable to my circumstances and condition my soul I trust shall return to rest with God who gave it as I hope for eternal salvation through the blessed Lord and Savior Jesus Christ. Item 2nd I desire and direct that all my just debts be paid without delay by my Executor herein after named as I am unwilling my creditors should be delayed of their rights especially as there is no necessity for delay. Item 3rd I desire and direct that five of my negroes to wit Newman aged sixty, Rachel age sixty, Lilan aged thirty five, Nancy fourteen years old and Harriett twelve years old household and kitchen furniture all be sold by my Executor as soon as practicable after my death and after sale of my property to be distributed as follows Item 4th I desire and direct that my beloved nephew Charles Baker and my beloved nieces Sealy Baker and Gilly Baker each of them have one hundred dollars apiece out of said proceeds. Item 5th I desire and direct and will that after the three above named each get one hundred dollars for the balance of the proceeds of the sale to be equally divided between the five following named nephews to wit Seaton Clark, Wiley Clark the two above named nephews the sons of William Clark and William C. Clarke and George Clarke both the above named nephews are sons of Alfred Clark and Sampson Cox who married the daughter of the above named William Clark. Item 6th. I give and bequeath to my beloved nephew Bradford Clark, likewise the son of William Clark, a negro boy by the name of Frank fourteen years of age and of yellow complexion. Item 7. I constitute and appoint my worthy nephew Sampson Cox my Executor to this my last will and testament. This the 15th day of December 1852 Eli Clark (His Mark) Signed sealed declared and published by Eli Clark as his last will and Testament in the presence of us the subscribers who subscribed our names hereto in the presence of said Testators & of each other December the 14th 1852. Chapman two of the subscribing witnesses to the foregoing will and testament of Eli Clark and who being duly sworn did dispose and say that they saw each, the said Eli Clark sign seal publish and declare on the 15th day of December 1852 the said instrument to be and contain his last will and testament; that they signed the same as witnesses in witness, that the other witness signed the same as a witness in the presence of the Testator; that the said Testator at the time of executing said will was of sound mind and that he executed the same voluntarily so far as they know or believe.
