Cannon party of the first part & James Rogan of the second part both of the county of St. Clair and sate of Alabama witnesseth that the said Malcomb D. Cannon party of the first part for and in consideration of eight hundred dollars to him paid in hand by the said James Rogan party of the second part the receipt whereof is hereby acknowledged hath this day bargained sold a liened infer offered and confirmed and by these presents doth bargain sell a lien infer offer and confirm unto the said party of the second part two certain parcels or tracts of land lying being and situated in the county of St. Clair and state of Alabama and in the Huntsville land district situated as follows first one tract or parcel being the (north west quarter section of land number eight in township fourteen of range four east in the district of Huntsville) and in the county and state above mentioned containing seventy acres and one hundreth of an acre second trac or parcel lying being and situated in county & states aforesaid in the Huntsville district as follows (beginning at the south west corner of the east half of section five township fourteen and range four east running east nine degrees north 4 poles 42 links to a stake or stone corner thence north six degrees west twenty poles to a stone corner then west six degrees south four poles & forty two links to the west line of said quarter as above thence south nine degrees east twenty two poles to the beginning corner making in all) together will all and singular the houses out houses buildings appurtenances rights and priviledges thereunto belonging or in any wise appertaining to said James Rogan his heirs and assigns executor and administrators forever and the only proper us benefit and behoof of him the said James Rogan his heirs executors administrators and assigns forever the said Malcomb D. Cannon doth hereby covenant to and with James Rogan his heirs &c aforesaid that he is well seized and possessed of the same and hath title in fee simple and good and lawful rights to bargain and sell and convey the same and doth hereby warrant and will forever defend the title to said premises to the said james Rogan his heirs and assigns forever against the claim or claims of all claiming under him as well as all persons and every person whatsoever as well as also the General Government In testimony whereof I set my hand and seal this day and year above written Malcomb D.
