AL, 1837-1862 ----------------------------------------------------------------------- Shelby County, Alabama Deed Book H, p. 220: State of Alabama Shelby County } This indenture made & entered into on this the 24 day of Aug 1841 between Wm Mason of the first part & James Stedham both of the county aforesaid of the second part witness that whereas me F. Move at the Shelby County Court hold in Aug 1841. recorded a Judgment against the said Wm. Mason as principal & Thomas Larrence & James Lewis as seentaries for the sum of 21 78/100 dollars damages besides 94 93/100 cast of suit & the said James Stedham has bound himself to pay said debt by the 25 day of Dec 1841 men the said Wm Mason being desirous of securing said Stedham against said payment & to furnish him with bonds to make said payment has & by these presents does hereby sell alien & convey to said James Stedham one wagon & one yoke of oxens of said oxen being of a reddish color the other rather of a white & dun color one horse sorel with but one eye to have & to hold to said Stedham his heirs & assigns forever upon this condition that if said manner shall by the 25 Dec 1841 pay said above named Judgment interest & cost then this trust deed to be void but in default of such payment or any part thereof said Stedham is to sell said property by or so much thereof as shall be of value sufficient to pay said payment interest & cost upon advertising the same 10 days at three public places in the neighborhood of the present residence if said mason rendering to said Mason the surplus after paying said Judgment interest & cost & the expenses of this trust said sale is to be made by public auction to the highest bidder & the property may remain in said Mason possession until the same shall be demanded said Stedham in testimony whereof the parties have signed & sealed & by agreement the date above.
