Orphans' Court, Aug. 28, 1848. THIS day came Hiram W. Sanders Administrator the estate of James Henderson deceased, and files his petition, setting forth in substance as follows. That the deceased died seized and possessed of the following tractor piece of Land to wit: 5O acres of Land, part at the Northeast quarter of section 17, in Township 23, of Range 21, lying and being in Tallapoosa County, aforesaid, and that the same cannot be equally, fairly, and beneficially divided among the heirs of the said deceased, without a sale thereof. That Nancy, wife of William G. Sanders, and Matilda Henderson, who are of full age, and Ann E. Henderson a minor who reside in Clark County, in the State of Arkansas, Jesse M. Henderson a minor, residing in Oktibbeha County in the State of Mississippi, Laurena, wife of Hiram W. Sanders, and James Henderson who are of full age, and Lemuel Henderson, Mary J. Henderson, Richard W. Henderson and William D. Henderson, who are minors residing in Tallapoosa County, are the only legal heirs and representatives of the said deceased, he therefore prays the Court to grant an order for the sale of the said Land. It is therefore ordered by the Court, that John A. Jordan, be appointed Guardian ad li im of the minor heirs, and that publication be made in the “State Guard,’’ a newspaper published in the city of Wetumpka for 40 days, notifying the non- resident heirs to be and appear at an Orphans Court to be held for said county, on the 2nd Monday it October next, to show cause, why the said petition should not be granted.
