Sturdivant, Judge of Probate in and for said County and State James M. Berry Executor of the estate of Silas Ray deceased, represents unto you Honor that said Ray died seized and possessed of the following lands among others to wit: the South ½ of Section 9, also the East of the South east quarter of section eight containing four hundred and forty acres. Your petitioner represents unto your Honor, this it will be impossible to settle up the matter of said estate for at least twelve months from this time as there is a suit now proceeding in the Circuit Court of Tallapoosa County and which if decided against said Ray will force the sale of the lands to the payment of his debts, and that the lands above set forth will in the mean time if not rented out be worth nothing to the estate of said deceased. The permission considered your petitioner prays your Honor to grant him an order to rent out the said lands for and during the year 1862, and your petitioner states that he is fully persuaded that the said lands if rented at private Sale and in Smaller divisions then the entire amount of lands set out above, would be more beneficial to the estate than than [sic] to rent the same at public outcry, therefore he prays your Honor grant him an order to rent said lands at public sale and in subdivisions upon such terms as to your Honor may see fit and proper, and for all such other and further orders as in the premise may be necessary.
