Sturdivant, Judge of Probate of said County. The petition of James M. Berry respectfully [can’t read] the unto your Honor that he has been duly appointed Executor on the last will of Silas Ray deceased that he immediately proceeded to examine and to take possession of the assets of said estate, and that he has had the same inventoried and appraised and returned to this Court, as the law directs, in the course of which examination petitioner found that said estate in was possessed of the following property consisting of one horse and mule, cattle, Hogs, old wagon, some blacksmith and plantation tolls, and the present crop of corn, cotton & etc which said property is of a perishable nature, in this that winter is approaching and said property is with difficulty kept together and [can’t ] forever [can’t read] In consideration of which your petitioner states that it is manifest that it will be beneficial to the interest of said estate to have said property sold at as early a day as feasible. Wherefore your petitioner prays your Honor to take cognizance of the subject matter of this petition and order the sale of said property and that said sale may be made as early a day as feasible as much as said property is wasting every day to the detriment and loss of said estate. Your Petitioner would respectfully suggest to your Honor that said sale should be made upon a credit of twelve months or until the 25th December 1862. And as in duty bound he will [can’t read] pray.
