Sturdivant, Judge of said Court. The Petition of James M. Berry respectfully represents unto your Honor, that the late Silas Ray, who was an inhabitant of this County at the time of his death, departed this life on the 13th day of May 1861, in said county at his residence, having a last will and testament, duly signed and published by him, and attested by Wilson L. Banks, and John A. Stow both of whom resides in said County, in which your Petitioner as appears from the itself, is named as one of the executors together with Daniel Ray and William Ray, which said will is hereunto produced to your Honor, and propounded fro Probate and record in the Court; You Petition further shows, that the widow of said deceased is Mrs. Sarah Ray who resides in this County and the following named persons are the only children and heirs at law of said deceased, viz. Ransom G. Ray, Daniel Ray, Elijah Ray, William Ray, Irvin Lawson Ray, Elizabeth Sowell wife of James M. Sowell, Sarah Ray wife of John Ray, and Charity Vickers wife of James Vickers, all of whom reside in Tallapoosa County, State of Alabama and are all twenty one years of age, except Irwin Lawson Ray, who is a minor under twenty one years of age, and over fourteen years of age. In consideration of all which, your Petitioner that subpoenas may be issued to bring in said subscribing witnesses to testify on such appointed day that due notice of this application may be given to the said widow and next of Kin of said deceased, and that such other proceedings, orders and decrees may be had and made in the premises as may be required and proper to affect the due probate, and record of said will according to law, and as in duly bound will ever [can’t read] James M. Berry Sworn to and Subscribed to before me May 27th 1861 Allen D. Sturdivant Judge of Probate RELINGUISHMENT The undersigned Daniel Ray and William Ray, represents unto your Honor that they we [?] appointed as executors upon the will of Silas Ray deceased, together with James M. Berry, the undersigned respectfully declines the executorship of said will, and in favor of said James M.
