Edwards ledwards6@nc.rr.com January 17, 2003, 5:21 pm Written: November 28 1859 Recorded: April 25 1860 Know all men by these presents that whereas James Berry formerly of the state and county aforesaid has departed this life leaving no will, we being his heirs have agreed to divide his estate without an administration all of said heirs being of lawful age and we do mutually agree that Juda Berry the widow of said deceased James Berry retain in her possession for her sole and separate use for her life the following property: (description follows of 60 acres in Section 20, 60 acres in section 2; both in Township 22 of Range 24; 4 slaves; various livestock and tools; and the household furniture). The reminder of the deed is an agreement to sell the remainder of the property and then sell everything upon Juda's death. Signatures: Judia Berry, W. R. Berry, M. T. Berry, Jas T. Berry, H. S. Phillips Additional Comments: James Berry died July, 1859 (the 1860 Mortality Schedule) of apoplexy. Full names of his seven children: Williamson Roby Berry, Miles T. Berry, James T.
