To have and to hold the afore granted premises to the said William Ledbetter, his heirs and assigns to their use and behoof forever. And I do covenant wit the said William Ledbetter, his heirs and assigns that I am lawfully seized in fee of the afore granted premises that they are free of all incumbrances [sic], that I have a good right to sell and convey the same to the said William Ledbetter, his heirs and assigns forever against the lawful claims and demands of all persons. In witness whereof I the said Thomas Ray have hereunto set my hand and seal this 17th Sept A. D. 1838 Thomas Ray-his mark Attest: Hiram Morris Joshua Starr, J. P. The State of Alabama Tallapoosa County I Joshua Starr a Justice of the Peace of the County aforesaid do hereby certify that on the 17th day of September 1838 eighteen hundred and thirty eight the above named Thomas Ray personally appeared before me and acknowledged the written instrument to be his free act and deed. Given under my hand and seal this 17th day September 1838 Joshua Starr, J. P. State of Alabama Tallapoosa County Know all men by these presents that Hannah Ray, wife of Thomas Ray the grantor of the within named for and in consideration of the sum of one dollar to me in hand paid, the receipt whereof I do hereby acknowledge, do hereby [can’t read] above relinquish and forever quit claim to William Ledbetter the grantee within named, his heirs and assigns all right, title, interest and claim to dower [can’t read several words] the said Thomas Ray, [can’t read several words] in and to the land and premises above describes. In witness whereof I have hereunto set my hand and seal this 17th September A. D. 1838 Hannah Ray-her seal [Attest] Hiram Morris Joshua Starr, J. P. State of Alabama Tallapoosa County I Joshua Starr a Justice of the Peace of the County aforesaid do hereby certify that I have this day examined the above Hannah Ray, the wife of Thomas Ray privately and apart from her said husband, and that on such private examination she acknowledges that she signed, sealed and delivered the foregoing instrument as her voluntary act and deed truly without any fear or compulsion of her said husband.
