RAY, JR. TO STARKS W. BANKS 1852 The State of Alabama Tallapoosa County Know all men by these presents that whereas I am indebted to Starks W. Banks in the sum of forty dollars and twenty five cents, evidenced by a promissory note bearing [can’t read] date and due the 25th day of December next, on which said note Ransom G. Ray Jun- as my security and being desirous of securing the payment of the said note when the same shall become due, and for and in consideration of the sum of one dollar to us in hand paid by the said Starks W. Banks, the receipt whereof is hereby acknowledged, do hereby grant, bargain, sell, enfeoff, convey and confirm unto the said Starks W. Banks, his heir and assigns all that piece or parcel of land situate lying and being in Tallapoosa County aforesaid and known and distinguished as the North East Quarter of the South East Quarter of Section Twenty Seven(27) in Township Twenty three (23) of Range twenty twp (22) East in Tallapoosa land district. To have and to hold the said piece or parcel of land with the appurtenances thereto belonging unto and to the only proper use and behoof of the said Starks W. Banks his heirs and assigns forever, [can’t read] trust [can’t read] that-if I shall pay or cause to be paid the above cited promissory note for forty dollars and bounty five cents at maturity then this conveyance to be void and of no affect, but if I shall fail to pay the said promissory note when the same shall become due, then [can’t read] trust-that the said Starks W. Banks shall sell the land hereby conveyed at public outcry for cash before the Court Hose door in the town of Dadeville first advertising the time and place of sale at three or more public places in the County for thirty days, one of which shall be at the door of the Court House and out of the proceeds of the sale of said land first to pay the costs of the sale then the said promissory note for forty dollars and seventy five cents and all interest due thereon and the surplus if any to me or my heirs and assigns. In testimony a hereof I have hereunto set my hand and seal this twenty-sixth day of March in the year one thousand eight hundred and fifty two Silas B. The State of Alabama Tallapoosa County I Luke Davenport an acting Justice of the Peace in and for the said County, do hereby certify that on the 26th day of March 1852 the above named Silas B. Ray, Jun- personally appeared before me and acknowledged that he signed sealed and delivered the foregoing deed on the day of the date thereof to the said Starks W.
