JOHN FRANKLIN AND WIFE TO S. Y. L. RAY 1853

The State of Alabama
Tallapoosa County

This indenture made and entered into this twentieth day of October in the year 
of your Lord eighteen hundred and fifty three between John Franklin and Kiddy 
Franklin his wife, of the one part and Samuel Y. L. Ray of the County of 
Randolph and the State of Alabama, of the other part, witnesseth that the said 
John Franklin and Kiddy Franklin for and in consideration of the sum of five 
hundred dollars to them in their hand paid by Samuel Y. L. Ray at and before 
the signing and sealing of these presents, the receipt whereof is hereby 
acknowledged, hath granted, bargained, sold, conveyed and confirmed unto Samuel 
Y. L. Ray, his heirs, executors, administrators and assigns the following piece 
or parcel of land, to wit, twenty acres of land being a part of the North East 
Quarter of the North East Quarter of Section thirteen, township twenty five of 
Range twenty three, commencing at the south west corner of said fourth, thence 
North opposite the head of the Tanyard Branch, thence East to the head of the 
branch, thence down said branch on the north side to the road above Tanyard, 
[can’t read] a road with water privileges thirty feet wide is excepted, thence 
down said branch on the north side to the corner of the horse lot,  [can’t 
read] a space of fifty feet for water privilege opposite the hors lot and 
thence due south to the south line of said north east Fourth, thence along said 
line to the beginning, containing twenty acres, be the same more or less 
including the Tanyard and working tolls on said premises.  To have and to hold 
the before described parcel of lands, together with all and singular the 
rights, numbers and appurtenances thereunto belonging and appertaining, to the 
said S. Y. L. Ray, to his heirs and assigns for their own proper use benefit 
and behoof forever in fee simple, the right & title we do hereby warrant and 
defend against ourselves, our heirs and assigns, and against the lawful claim 
or demand of all other persons lawfully claiming the same.
In testimony whereof we have hereunto set our hands and seals the day and date 
before written.
