JAS. M. RAY TO LUKE DAVENPORT 1858

The State of Alabama
Tallapoosa County
Know all men by these presents that whereas I am justly indebted to Luke 
Davenport in the sum of one hundred & fifty dollars fro provisions & furniture 
this James Ray by the said Davenport and whereas I the said James Ray being 
desirous of securing the payment thereof have this day bargained and sold unto 
the said Davenport all of my present crop of corn & cotton now growing and 
fodder upon the following condition that if the said Ray fails to pay off said 
debt of one hundred and fifty dollars by the first day of Nov. next then in 
that case the said Davenport is hereby empowered to take said crop of corn & 
cotton and sell the same at private or public sale if sold at public outcry 
give ten days notice of the time and place shall sell the same to the highest 
bidder for cash at the residence of the said Ray and apply the proceeds thereof 
to the payment of said debt and the remainder to be paid over to the same Ray.  
In testimony whereof I have hereunto set my hand this June 19th 1858.

I William Griffin Clerk of the Circuit Court for said County hereby certify 
James M. Ray whose name is signed to the foregoing conveyance and who is known 
to me acknowledged before me on this day that being informed of the contents of 
the conveyance he executed the same voluntarily on the day the same bears 
date.  Given under my hand this Sept 25th 1858

The foregoing conveyance was filed in office for record the 25th Sept. 1858 and 
duly recorded the same day.
