RAY TO A. D. STURDIVANT 1856 The State of Alabama Tallapoosa County Know all men by these presents, that whereas Allen D. Sturdivant is security for me James M. Ray upon a certain promissory note made payable to John Bostock for fifty dollars, due the twenty fifth day of December 1856, and dated the 25 day of February of the same year, and the said James M. Ray being desirous to secure the said Allen D. Sturdivant upon his liability as said security, I hereby bargain, sell and convey unto the said Allen D. Sturdivant eight head of cattle, consisting of two milch cows, one red color, the other white and red spotted, and two calves, and two heifer yearlings, red and white spotted & two bull yearlings one white the other black color, Now if the said James M. Ray shall pay off or cause to be done the said above promissory note, as set forth and described at Maturity together with all the expenses accruing upon this mortgage, and all interest that may accrue upon said note, then this obligation to be null and void, to all intents and purposes, but if the said James M. Ray should fail to pay off or cause to pay off said above described note at maturity, then the said Allen D. Sturdivant shall be authorized and empowered to seize upon and take and expose to sale at public outcry before the court House door in the town of Dadeville or at the premises of said James M. Ray, or privately as he may think best, by giving ten days notice at three or more places in the county of the time and place of such sale, the aforesaid described property, in order to pay of said promissory note, and after discharging the amount of said note, if any remainder be, and the expenses of this mortgage, the balance to be paid over to the said James M. Ray. In testimony whereof I have hereunto set my hand and seal. This March the 4th 1856. James M. Ray The State of Alabama Tallapoosa County I, Luke Davenport an acting Justice of the Peace in and for the County and State aforesaid, hereby certify that James M. Ray, whose name is signed to the foregoing conveyance, and who is known to me, acknowledged before me, on this day, that being informed of the contents of the conveyance, he executed the same voluntarily on the day the same bears date.
