TO JAMES M. PEARSON 1855 The State of Alabama Tallapoosa County Know all men by these presents that whereas I ransom Ray am indebted to James M. Pearson by two promissory notes amounting in the aggregate to five hundred and eight nine dollars bearing even date with these presents and due on the 25th day of December next and being desirous of further securing the payment of said notes to said Pearson, as also for the further sum of one dollar to me in hand paid by said Pearson the receipt whereof is hereby acknowledged, hath this day bargained and sold unto the said Pearson, and do by these presents bargain sell & convey unto said Pearson the following described negro girl. To wit a negro girl slave named Mary about twelve years old of copper complexion. To have and to hold to his own proper use & behoof forever, on the following conditions to wit-that said girl Mary is to remain in the possession of said Ray for the present year and if said Ray shall payoff and discharge both of said notes above specified by their maturity and all cost and charges in & about this mortgage then this mortgage is to be null and void. But should said fail or refuse to pay off the same, by their maturity as above specified then said Pearson his agent or Attorney Executors administrators or assigns is hereby authorized & empowered to take or seize possession of said negro, and after giving ten days notice by posting advertisements at the Court House door and at two other public places in the County aforesaid, giving notice of the time and place of said sale. To sell said negro girl to the highest bidder for cash at the Court House door in said County at public outcry; and apply the proceeds thereof to the payment of said notes & the cost & charges of this mortgage and the balance if any to be paid over to said Ray, also Pearson is hereby authorized to convey the title & possession of said negro girl to the purchaser. In witness whereof I the said Ray have hereunto set my hand and seal this 21st day of May A. D. 1855 Ransom Ray, Sr.-his mark The State of Alabama Tallapoosa County I Luke Davenport and [sic] acting Justice of the Peace in and for said County hereby certify that Ransom Ray Sen. whose name is signed to the foregoing conveyance and who is known to me acknowledges before me on this day that being informed of the contents of the conveyance he executed the same voluntarily on the day the same bears date.
