SILAS YERBER TO RANSOM RAY, SR. 1858

The State of Alabama
Tallapoosa County

Know all men by these presents that whereas Ransom Ray, Sen. Being my security 
to James M. Pearson for the sum of one hundred & five dollars & thirty seven & 
a half cents due by three promissory notes as follows 3 notes for forty five 
dollars each & the other for fifteen 37/100 dollars all due the 1 day of 
January 1859 & bearing date the 29 day of March 1858 and being desirous of 
securing the said Ransom Ray and in and for the consideration of one dollar to 
me in hand paid the receipt whereof I hereby acknowledge have this day 
bargained sold and conveyed unto the said Ray 1 cart & 2 steers & 1 buggy & 
mule to have and to hold the afore mentioned cart & 2 steers & mule & buggy to 
his own use and behoof forever his heirs and assigns forever in trust-now if I 
pay or cause to be paid the above described note at maturity with the interest 
& cost thereon then this obligation to be null & void otherwise to remain in 
full force & virtue if I fail so to do then the said Ray his agent or attorney 
shall have full power to take in to possession the above described property and 
pay off and satisfy said notes and the deed and expenses of said sale and if 
any over pay to me or my heirs.
Given under my hand and seal Signed Sealed dated the 27 day of March A. D. 1858.

I Luke Davenport an acting Justice of the Peace in and for said County herey 
certify the Silas Yarbrough whose name is signed to the foregoing and who is 
known to me acknowledged before me on this day that being in formed of the 
contents of the conveyance he executed the same voluntarily on the day the same 
bears date.
Given under my hand this May 5 1858.
