J. M. RAY TO T. C. THOMAS 1858

The State of Alabama
Tallapoosa County

Know all men by these presents that whereas I James M. Ray are justly indebted 
to James M. Pearson in the sum of ninety dollars due the twenty five day of 
December 1858 by two promissory notes dated the 15th day of March 1858 and 
whereas T. C. Thomas is my security upon said notes as above described and I 
the said J. M. Ray being desirous of securing and keeping the said Thomas from 
paying any portion of said notes above described have this day bargained and 
sold unto the said T. C. Thomas one by mule about four years old the only mule 
owned by the said Ray upon the following condition that if the said Ray fails 
to pay off said notes when the same becomes due then in that case the said 
Thomas is hereby empowered to take said mule into his possession and sell the 
same at private or public sale and after paying all necessary expenses apply 
the proceeds to the payment of said notes as above described and if any over 
the same to be paid over to the Ray.  In testimony whereof I have hereunto set 
my hand and seal this March 16th 1858.

I Luke Davenport an acting Justice of the Peace in and for said County hereby 
certify that James M. Ray whose name is signed to the foregoing conveyance and 
who is known to me acknowledged before me on this day that being informed of 
the contents of the conveyance he executed the same voluntarily on the day the 
same bears date.
Given under my hand this March 16 1858

The foregoing conveyance was filed in office for record March 16th 1858 and 
duly recorded the 8th of April 1838 (sic)
