NORFELT WELLS TO SILUS RAY 1857

The State of Alabama
Tallapoosa County
Know all men by these presents that [can’t read] as Silus [sic] Ray is my 
security To H. J. Pickard for one hundred and forty five dollars due the twenty 
fifth day of December 1857, by promissory note, and being desirous of securing 
and holding the said Ray harmless, I do hereby grant, bargain, sell and convey 
unto the said Silus [sic] Ray all that parcel of Land known as Fraction H of 
Section Twenty eight in Township Twenty, then of Range Twenty Two East 
containing thirty acres.  To have and to hold the aforesaid granted premises 
unto him the said Silus [sic] Ray, his heirs and assigns.  This the 9th day of 
February 1857.  The condition of the above mortgage sale is such that if the 
said Norfelt Wells shall pay off the above described note at maturity and 
[can’t read] the said Silus [sic] Ray harmless, Then the above mortgage to be 
null and void.  But if I should fail to pay off the note at maturity then the 
said Silus [sic] Ray is empowered and authorized to expose the said Land at 
public sale, by giving public notice, three or more places in the County by 
posting up the same in writing and the proceeds thereof to be applied to the 
satisfaction of the said note and expenses of this mortgage and the surplus if 
any after satisfying said note and expenses of this mortgage to be refunded to 
the said Norfelt Wells.  In testimony whereof I have hereunto set my hand and 
seal the day and year above written.

I Allen D. Sturdivant a Justice of the Peace for the County and State 
aforesaid, hereby certify that Norfelt Wells whose name is signed to the within 
conveyance and who is known to me, acknowledges before me, on this day, that 
being informed of the contents of the conveyance he executed the same 
voluntarily on the day the same bears date.
Given under my hand this 9th day of February A. D. 1857.

The foregoing conveyance was filed in office for record 9th February 1857 and 
duly recorded March 9th 1857.
