Ray of the state and county aforesaid and indebted to James M. Pearson by promissory note in the sum of two thousand and one 94/100 dollars dated July 19th A. D. 1862 and due 25th December A. D. 1862 and being desirous of securing the said Pearson in the payment of said sum of money of said note specified & for the further consideration of one dollar to me in hand paid, the receipt whereof is hereby acknowledged, I do hereby sell & convey the following described negro slaves to the said Pearson in absolute right, to wit; Lewis a man about twenty fours years of age, Mary a woman about nineteen years old & her child Mariah about two years old, Harriett a woman about twenty six years old. To have and to hold said negroes absolutely on the following conditions to wit; that if said Ray shall pay off and discharge said note with the cost of this mortgage by the day the same becomes due, then this mortgage to be null and void, but if not paid off & discharged by that time, the said Pearson his executors, administrators assigns or agent is hereby empowered & authorized to sell said negroes or so many thereof to the highest bidder for cash at the court house door in the town of Dadeville within the legal hours of sale (after advertising the same in a newspaper published in said town or by posting notice at three public places in said County for twenty day before the day of sale) as will be necessary to discharge said note & costs & cost of this mortgage. That after paying off said note & interest and all costs therewith connected the said Pearson is to pay over to said Ray whatever of surplus there may be in his hand and to release any of said slaves to him and sold under said mortgage said Ray is hold said negroes within the County till the maturity of said note & so long thereafter as said Pearson may agree. Sturdivant Judge of the Court pf probate for this County & State aforesaid hereby certify that A. J. Lawery a subscribing witness to the within & foregoing conveyance known to me appeared before me this day and after being sworn related that Ransom Ray Sr. the grantor in this conveyance voluntarily executed the same in his presence on the day the same bears date & that he subscribed his name as a witness in the presence of the grantor.
