All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/al/alfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Beverly Giles Loffler beverly@jloffler.com February 6, 2005, 2:51 pm Written: December 16 1862 Recorded: December 30 1862 Transcribe by Beverly Giles Loffler beverly@jloffler.com Tallapoosa Co., AL Deed Book N Page 241 LDS Microfilm Number 1304526 Salt Lake City UT YARBROUGH TO RAY 1862 The State of Alabama Tallapoosa County Know all men by these presents that I Silas Yarbrough being indebted to Ransom Ray in the sum of two hundred & thirteen 92/100 dollars by promissory note made the 16th day of December 1862 and payable the 25th day of December 1863 and I the said Silas Yarbrough being desirous of securing the said Ray in the payment of the above debt, do this day bargain sell and convey unto the said Ray the following property to wit; one Sorrell mare & colt one yoke of oxen to have and to hold the aforementioned property to his use, the consideration of the above obligation is such that if the said Silas Yarbrough do pay or cause to be paid the above note at the time of Maturity then the above obligation is to be null and void, but if I the said Yarbrough fail to pay or cause to be paid the above note at the time of Maturity then the said Ray shall have power to seize and take in possession the above property and sell as much or all as will satisfy the above debt after twenty days notice. Given the 16th day of December 1862. Silas Yarbrough-his mark Signed in the presence of James M. Ray The State of Alabama Tallapoosa County I Joseph T. Taylor an acting Justice of the Peace for said County do hereby certify that Silas Yarbrough whose name is signed to the within and foregoing conveyance, who is known to me, acknowledges before me after being informed of the contents of the foregoing conveyance he executed the same the day the same bears date. In testimony whereof I have hereunto set my hand and seal the 16th day of Dec. 1862 Joseph T. Taylor, J. P.
