All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/al/alfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Beverly Giles Loffler beverly@jloffler.com February 6, 2005, 2:54 pm Written: January 30 1861 Recorded: February 4 1861 Transcribed by Beverly Giles Loffler beverly@jloffler.com Tallapoosa Co., AL Deed Book M Pages 759 and 760 LDS Microfilm Number 1304526 Salt Lake City UT FARRAR AND WIFE OT RAY 1861 The State of Alabama Tallapoosa County Where as we Franklin Farrar and Polly Farrar his wife of the County & State aforesaid for & in consideration of Silas Ray of the same County & State standing on our son Franklin [the name Franklin is marked through and the name Silas is substituted] Silas Farrar’s bond for his appearance at the March Term of the Circuit Court of said County & for Term to Term hereafter until discharged by law, we have this day bargained, sold, and conveyed to said Silas Ray his heirs administrators executors & assigns, the following property to wit; The N W ¼ of N E ¼ of Sec Thirty three (33) Township Twenty two (22) & Range Twenty two (22), also the S W ¼ of N W ¼ Section four (4) Township Twenty one (21) Range Twenty two (22), Also N W ¼ of N W ¼ Sec Thirty four (34) Township Township [sic] two & Range Twenty two (22). Also S W ¼ of N W ¼ Sec four (4) Township Twenty one (21) Range Twenty two (22) All being situate in the County & State aforesaid. Also three mules, Ten head of Cattle, marked crop & split in the right ear & crop of the left. Also one chestnut sorrel mare & colt. To have and to hold the said Silas Ray his heirs executors, administrators & assigns forever. That we have a good right mortgage said property to the said Ray. Whereof we have this day hereunto set our hands & affixed our seals the 30th day of January 1861. The condition of the above obligation is such that whereas if the said Silas Farrer shall appear at the next Term of the Circuit Court of said County & from Term to [missing word Term] thereafter until discharged by law then this obligation to be void, otherwise to remain in full force & effect. Minyard an acting Justice of the Peace in and for the County and State aforesaid, hereby certify that F. R. Powers a subscribing witness to the foregoing conveyance, known to me, appeared before me this day & being sworn, Stated that Franklin Farrar & Polly his wife the grantors in the conveyance voluntarily executed the same in his presence & in the presence of the grantors and other witness & that such other witnesses subscribed his name as a witness in his presence.
