CARTER TO RAY 1861

The State of Alabama
Tallapoosa County
Know all men by these presents that E. L. Carter hath this day bargained and 
sold unto Samuel T. Ray one yoke of oxen, one of which is Red, the other red 
and white pided [?] and about five years old also one ox wagon all for the sum 
of Twenty eight & 22/100 dollars to me in hand paid.  Now if the said E. L. 
Carter shall pay or cause to be paid the above sum of money together with the 
interest thereon by the first day of January 1862 then this mortgage to be void 
but if the said Carter fails to pay said Twenty eight & 22/100 dollars and 
interest then said Samuel T. Ray is to sell said property after giving ten days 
notice of the time and place of said sale and count the proceeds thereof to the 
payment of said debt or so much thereof as may require to satisfy said debt and 
cost of sale.  In witness whereof I hereunto set my hand and affix my seal the 
5th September 1861.

I Phillip Wolf a Justice of the Peace hereby certify that E. L. Carter whose 
name is singed to the foregoing conveyance and who is known to me acknowledged 
before me this day that being informed of the contents of conveyance he 
executed the same voluntarily on the day the same bears date.  Given under my 
hand this 10th day of Sept 1861.

Filed in office for record the 16th day of September 1861 and duly recorded the 
same day.

Additional Comments:
This deed begins as a sale from E. L. Carter to Samuel T. Ray.  However, the 
deed reverses the parties and Carter becomes the purchaser and Samuel Ray the 
seller.
