TO WOLF 1864 State of Alabama Tallapoosa County To all whom these presents shall cover I Samuel T. Ray of said County and State administrator of James Ray late of said County deceased intestate send Greetings. Whereas by an order made at a Probate Court held at Dadeville within the County of Tallapoosa on the 30th day of December, I the said Samuel T. Ray was licensed and empowered to sell and pass deeds to convey the real estate of the said James Ray hereafter described, and whereas I the said Samuel T. Ray having given public notice of the intestate sale by causing a notification thereof to be printed and inscribed three weeks successively in the newspaper called the [can’t read] and Times printed in Dadeville agreeable to the order and direction of said Court, and having given [can’t read] and taken the bond by law in such cases required previous to fixing upon the time and place of sale, did on the 25th day of January, pursuant to the license and notice aforesaid sell, by public auction the real estate of the said James Ray herein after described. To Phillip Wolf of Tallapoosa County for the sum of twenty seven hundred dollars, he being the highest bidder therefore. Now therefore know you that I the said Samuel T. Ray by virtue of the power and authority in me vested as aforesaid and in consideration of the aforesaid sum of twenty seven hundred dollars to me paid by the said Phillip Wolf, the receipt whereof is hereby acknowledged, do hereby grant, bargain, sell and convey unto the said Phillip Wolf his heirs and assigns all that parcel of land known as the north east quarter of Section twenty nine in Township 24, of Range 22 and containing one hundred and sixty acres more of less, also the south half of the north west quarter of section twenty nine same Township & Range and bounded as follows, commencing at the half mile stake on the west line of said section, thence north to a stake half the distance from the half mile stake to the corner, thence east too a Branch, thence down the run of the Branch to a chestnut tree, thence south to dividing line of said section, thence west to beginning and containing sixty acres more or less. To have and to hold the above granted premises to the said Phillip Wolf his heirs and assigns to his use their own proper use, benefit and behoof forever. And I the said Samuel T. Ray for myself and my heirs executor and administrator do hereby covenant with the said Phillip Wolf his heirs and assigns that in pursuance of the license aforesaid I took the oath and gave the bond by law required gave public notice of said sale as above set forth. In testimony of which I the said Samuel T. Ray have hereunto set my hand and affixed my seal the 23rd day of February 1864. Samuel T. Ray-his seal Admin. of James Ray deceased. Attest. Polk State of Alabama Tallapoosa County Roderick McKinon a Justice of the Peace in said County certify John Hutchenson subscribed within to the foregoing conveyance, who is know to me, appeared before me on this day and being sworn saith that Samuel T. Ray admin of James Ray deceased the grantor in the conveyance [can’t read] executed same in his presence and in the presence of the other subscribing witness on the day the same bears date, that he attested same in the presence of [can’t read] witness and that such other witness subscribed his name of the grantor and in his presence.
