Ray of the first part and P. J. Wolfe of the second part. Witnesseth: that whereas Joseph B. Ray holds two promissory notes on P. J. Wolfe for seventy five dollars each, given 4th of October 1866 bearing interest from date and due 25th December 1868, one of the notes has a credit of fifty-eight 38/100 Dollars, had 1st Feb. 1870 the above described notes were given to Moses W. Lackey for Land, which is described in the face of the Notes. The amount due on the above mentioned notes the 1st January 1871, was one hundred and forty dollars, which one hundred and forty dollars is to bear interest from 1st January 1871 and to be paid by the 25th day of December with interest from the 1st January 1871. do this day mortgage bargain sell and convey to the said Joseph B. Ray the following described Land viz. One hundred and sixty acres more or less known as the South East ¼ of Section eight (8), Township twenty four, 24, Range twenty two, 22, all in the Tallapoosa Land District. To hold in trust for the prompt payment of the one hundred and forty dollars and interest by the 25th December 1871, with the right to take possession of the same, if the one hundred and forty dollars and interest remain unpaid a longer period than the 25th December 1871 and sell to the highest bidder for Cash at the Court Ground of the Beat in which said land lies after giving Ten Days notice of the same at the Court Ground of said Beat and two other public places in said County and pay himself and all costs, recording fees etc. and the remainder if any to the said P. J. Wolf. Nevertheless, if the one hundred and forty Dollars and interest shall have been paid by the 25th day of December 1871, then this instrument to be null and void, otherwise to remain in full force and effect.
