Heard in the sum of Sixty five dollars evidenced by a promissory note due and payable the 15th day of October 1870, money advanced bona fide to enable me to make my present crop, and without which it would be impossible for me to make such crop, and being desirous to secure the said E. W. Heard in the payment of said sum of money, have this day bargained and sold, and by their presents to grant, bargain and sell unto the said E. W. Heard the following described property, the rights and title I guarantee to be in me and that is free from all encumbrances to wit; 2, Two bales of Cotton Weighing five hundred pounds and said Cotton to be packed and ready for market. To have and to hold the fore granted property unto him, the said E. W. Heard his heirs and assigns forever; upon the following conditions, nevertheless, should I pay off and discharge said notes at maturity, or cause the same ti be done, then this obligation to be null and void; otherwise to remain in full force and effect, and the said E. W. Heard is hereby authorized and fully empowered to seize and take possession of the fore granted property, and expose the same to sale at public outcry to the highest bidder for cash, after having first given 10 days notice of the time, place and terms of sale, together with a description of the property, posted at the Court House door in the town of Dadeville and the proceeds of said sale apply to the satisfaction of said debt and expenses of this mortgage and sale, the balance, if any, pay over to the maker of this instrument or his legal representatives. In witness Whereof I have hereunto set my Hand and seal the 4th day of April 1870. William B. Ray-his mark State of Alabama Tallapoosa County I, Jas. M. Ray Justice of the Peace for said County, hereby certify that William B. Ray whose name is signed to the foregoing conveyance, acknowledged before me, this day, that being informed of the contents of the conveyance, he executed the same & voluntarily on the day the same bears date.
