B. Ray of the State and County aforesaid for and in consideration of the sum of one dollar to me in hand paid at and before the sealing and delivery of these presents, bargained, sold and delivered and by these, do bargain, sell and confirm unto Joseph R. Luke his heirs and assigns a certain brown mare mule (now in possession of the said W. B. Ray) and the entire corn and cotton crop of the said Ray planted and now growing on the lands of said J. R. Luke, unto the said J. R. Luke his heirs and assigns in fee simple forever. The condition of the above obligation is such that if the above bound W. B. Ray shall pay or cause to be paid unto the said J. R. Luke his heirs or assigns, a certain promissory note of hand for one hundred and forty dollars and dated on the 30th day of August 1867 and due on the 25 day of December 1868, then this obligation to be null and void. Now if the said W. B. Ray shall fail or refuse to pay and discharge the said promissory note at maturity, then the said J. R. Luke shall have full power and authority to advertise the said described mule & crop of the said W. B. Ray at three public places in the Beat No (1) one for twenty days and proceed to sell at public outcry to the highest bidder for the above described mule & crop for cash and after paying the said note, and all the cost accruing by the proceeding, to pay the surplus if any to the said W. B. Ray. In witness whereof I have hereunto set my hand this 20th day of April 1868. W. B. Ray-his mark The State of Alabama Tallapoosa County I C. M. Graves an acting Justice of the Peace in and for said County hereby certify that W. B. Ray whose name is signed to the within mortgage and who is known to me acknowledged before me, on this day that being informed of the contents of said conveyance he executed the same voluntarily on this 20th day April 1868.
