All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/al/alfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Beverly Giles Loffler beverly@jloffler.com February 15, 2005, 2:55 pm Written: June 10, 1868 Recorded: June 13, 1868 Transcribed by Beverly Giles Loffler beverly@jloffler.com Tallapoosa Co., AL Deed Book O Page 745 LDS Microfilm Number 1304527 Salt Lake City UT RAY TO YOUNG 1868 The State of Alabama Tallapoosa County Know all men by these presents that I Casse Ray am justly indebted to John Young in the just & full sum of forty dollars due the first day of November next and being desirous of securing the said John Young in the payment of said sum of money hath this day bargained & sold & by these presents do bargain & sell unto the said John Young his heirs and assigns four hundred pounds of Gin Cotton to be delivered at Richard Fields Gin house at the maturity of said indebtedness and to more effectually secure the said John Young in the payment of said indebtedness I the said Casse Ray hereby mortgage & sell unto the said John Young the dark bay mule and my entire crop that I may make this year (1868) & if the said Casse Ray fails to deliver the aforementioned four hundred pounds of Gin Cotton at the time & place mentioned in this instrument the said John Young is hereby empowered to take possession of said mule & crop and after giving legal notice as the law directs to sell the said mule & crop to the highest bidder and apply the proceeds of said sale to the payment of said indebtedness & after pay off and discharging said indebtedness all cost and expenses that may accrue thereto, to pay over the remainder if any to the said Casse Ray, and the said Casse Ray shall deliver the before mentioned four hundred pounds of Gin Cotton at the time and place before mentioned then this instrument is null and void. Otherwise to be in full force and effect. In testimony whereof I the said Casse Ray have hereunto set my hand and seal the 10th day of June 1868. Berry a Justice of the Peace in and for said County hereby certify that Casse Ray whose name appears to the within conveyance did execute the same in my presence voluntarily on her part the day the same bears date.
