Ray, Joseph T. Taylor and Wesley Taylor of the County and state aforesaid are justly indebted to William C. Gresham of the same place in the sum of four hundred & twenty one dollars and fifty cents due by promissory note bearing same dat with this instrument and due the 25th day of December next and being desirous of securing the payment of said note at the time it shall fall due, as well as the further sum of one dollar to us in hand paid by said Gresham and the receipt whereof we do hereby acknowledge do hereby bargain, sell and convey unto the said Gresham his heirs and assigns the following described real and personal property to wit; the south west ¼ of the South west ¼ & north west ¼ of the south east ¼ & the north east ¼ of the south east ¼ all in section twenty three (23) of township twenty two 22 of Range twenty two 22, the west ½ of the south west ¼ & the north east ¼ of the north west ¼ all in section twenty three, also the north west ¼ of the north west ¼ of section twenty seven 27 all in township 22, and Range twenty two 22, also the north west ¼ of the north west ¼ in section twenty 20 of township 22, and Range twenty 22 [?] also one Sorrell horse about nine years old, also all the crops of corn and cotton that we raise upon our several farms for the year 1867. All the above described land being and lying in the state of Alabama & Tallapoosa County. To have and to hold the afore bargained and sold real and personal property, that we are lawfully seized in fee of the afore bargained and sold real and personal property that they are free from all encumbrances; that we have a good right to sell and convey the same unto the said W. C. Gresham and that we warrant and forever defend the same against ourselves and our heirs & against the claims of all other persons whatsoever. In [can’t read] nevertheless that is to say if the said James M. Ray, Joseph T. Taylor and Wesley Taylor shall pay off and discharge the afore described note with all interest accruing thereon at maturity then the above sale to be null and void, but if this said J. M. Ray, J. T. Taylor and Wesley [Taylor is missing] shall fail to pay off and discharge said note at maturity then the said Gresham is hereby authorized and empowered to take in possession the above described real and personal property and expose to sale all of said property before the Court House door in the town of Dadeville after giving twenty days notice of the time and place of sale by posting written notice at the Court House door in the town of Dadeville and then proceed to sell said real and personal property at public outcry to the highest bidder for cash, and apply the proceeds of aforesaid sale together with all costs accruing on this instrument and sale as all costs as above stated, if there be a surplus said surplus is to be paid over by the said Gresham to the said J. M. Ray, J. T. Taylor and Wesley Taylor. Witness our hands and seals this the 9th day of March A. D. 1867. Jas. M. Ray-his seal Joseph T. Taylor and Wesley Taylor whose names are signed to the within and foregoing conveyance who is known to me acknowledged before me, after being informed of the contents of the conveyance they executed the same voluntarily on the day the same bears date.
