PICKARD The State of Alabama Tallapoosa County Known all men by these presents that Absolem NIX of the county of Coosa of aforesaid for and in consideration of the sum of two hundred sixty four and 48/100 dollars to me in hand paid by Henry J. PICKARD the receipt whereof I do hereby acknowledge have this day granted bargained and conveyed and by these presents do grant bargain sell and convey unto the said Henry J. PICKARD his heirs and assigns the following described tract or parcel of land to wit the east half of the south west quarter and the west half of the south east quarter all of section three township twenty four of range twenty two being and lying in the county and state aforesaid containing one hundred and sixty acres more less to have and to hold the afore granted premises unto him the said Henry J. PICKARD his heirs and assigns in fee simple forever and I the said Absolem NIX do hereby covenant with the Henry J. PICKARD his heirs and assigns that I am lawfully seized of the aforgranted premises that I have a good right to sell and convey the same unto the said Henry J. PICKARD and that they are free from all incumbances and I the said Absolem NIX as hereby warrant and defend the right and title to the said premises to the said Henry J. PICKARD his heirs and assigns the foregoing sale is upon the following condition and for purpose the herein after expressed that whereas the said Absolem NIX is justly indebted to the said Henry J. PICKARD to the amount of two hundred and sixty four and 48/100 dollars which is now in six executions against me the said NIX and Simeon HAND as security obtained before Daniel BOON Justice of the peace in said county besides cost of said suit now if the said Absolem NIX do pay or cause to be paid unto the said Henry J. PICKARD said amount and in said six execution as aforesaid with the [cost] of said [suit when] he the said PICKARD shall demand payment thereof from me the NIX then this sale to be void and of no effect but in the event the said Absolem NIX shall fail to pay off [and] discharge the said sum of two hundred and sixty four 48/100 dollars the amount above and said six execution as well as the cost of said [suit] or any part thereof when the payment of the same shall be demanded of me the said NIX as aforesaid then the said Henry J. PICKARD is empowered and authorized and I the said Absolem NIX as hereby authorized and empowered the said Henry J. PICKARD to expose to sale the aforesaid described lands after given public notice in three or more public places in said county in writing for twenty days before the sale of the time and place of sale the same to be sold to the highest [bidder] at public outcry and the proceeds arising from said sale to be applied to the payment of said six executions or so much as remain due and unpaid together with cost now due as said execution and if any thing shall be left and remaining in the hands of the said PICKARD after the payment of said expenses executions and cost as aforesaid and the necessary cost and expenses incident to said sell from the state of the above described lands the same is to be paid over to me the said Absolem NIX in testimony where of I the said Absolem NIX have this the 25th day of February AD 1852 signed, sealed, and delivered this instrument to the said Henry J. PICKARD on the day its date and for the purpose therein contained and that he saw Jesse WHITE assigned the same as a witness and he himself was a subscribing to witness the same Given under my hand and seal 29th day of September AD. 1852 Daniel BOON J.
