CASON to H. J. PICKARD The State of Alabama Tallapoosa County Know all men by these presents that whereas I Eldridge CASON are justly indebted to H.J. PICKARD in the sum of one hundred and sixty eight dollars 95/100 evidenced by one promissory note bearing date herewith and due the twenty fifth day of December next and also one note made payable to F.G. SMITH for $22.85 cts now therefore in order to secure the said PICKARD in the punctual payment of the same I hereby sell and convey unto the said PICKARD the following property to wit my entire corn and cotton crop that I may grow [and] raise during the present year to have and to hold the aforegranted property unto the said PICKARD his heirs and assigns [upon] the following condition to wit. If I the said Eldridge CASON shall will and truly pay off or cause to be paid the above described notes at maturing then the above sale to be void otherwise to remain in full force and effect and I authorize the said PICKARD in case of failure on my part to pay the above notes at maturity to take possession of the above described property after advertising the same ten days mentioning the time and place of sale to sell the same at public outcry at William HARDEY Gin for cash and apply the proceeds of such sale to the payment of the above notes and interest and if any over to pay to me the said Eldridge CASON in witness whereof I here unto set my hand and seal this the 4th of May 1858 his Eldridge x CASON mark Test Lafayette GOODWIN The State of Alabama Tallapoosa County I Simeon GOOLSBY Judge of Probate hereby certify that Lafayette GOODWIN a subscribing witness to the foregoing conveyance known to me appeared before me this day and being sworn stated that Eldridge CASON the grantor in the conveyance voluntarily executed the same in his presence on the day the same bears date.
