PICKARD and Goode BRYAN The State of Alabama Tallapoosa County By virtue of a fina facious issued from the Circuit Court of Tallapoosa county in said state at the suit of DARROW and LEMORE and others against Elijah McLEMON (McLEMORE) deceased bearing date eighteenth day of April 1840 and to me directed I Martin T. ELLIS Sheriff of said county of Tallapoosa did lately levy on and seize the lots tracts or parcels of land hereinafter specified and after being duly and publically advertised according to law did at Dadeville in said county of Tallapoosa on Monday the Seventh day of September 1840 proceed at public outcry to sell the same when Henry J. PICKARD and Goode BRYAN were the highest and best bidder therefore at the price of Four hundred and fifty dollars the same being knocked of to them the said Henry J. PICKARD and Goode BRYAN for the sum aforesaid in consideration of which I Martin T. ELLIS Sheriff as aforesaid do hereby bargain sell and convey unto them the said Henry J. PICKARD and Goode BRYAN their heirs and assigns the following described property to wit all those certain lots and parcels of land situate lying and being in the town of Dadeville in Tallapoosa county in the state aforesaid known and distinguished in the place of said town and survey thereof by John H. [BREADUAX] Esquire [surveyor] of lots numbers three (3) four (4) five (5) and six (6) in block number eleven (11) together with all and singular the eighty eight [membe xxxxr hired items] and to the same belonging or any xxx incident as appertaining. To have and to hold said bargained property or promissory note then the said Henry J. PICKARD and Goode BRYAN their heirs and assigns forever and I the said Martin T. ELLIS Sheriff as aforesaid do so far the office of sheriff authorized me hereby warrant said property or real estate unto them the said Henry J. PICKARD and Goode BRYAN their heirs and assigns and the same to have hold use and enjoy in the same manner the aforesaid Elijah McLEMON deceased defendant as aforesaid could or might have held and enjoyed said property had not the same been seized and sold by virtue of the aforesaid Fina Facious issued from the said circuit court as aforesaid on the eighteenth day of April AD 1840 as aforesaid in testimony whereof I the said Martin T.
