Greeting that I jorden Milam in my right mind and with the fear of God before my eyes and for the good and welfare of my family and for the Benefit of my dreditors and the debtors. I do this day the 17th August - in the year of our lord one thousand eighteen hundred and fifty five in my right my mind and senses do will and give To my wife Elizabeth to have and to hold as long as She may live my property as follows when my just debts are settled the northeast Quarter of the north west Quarter of Section Twenty of ? twenty Township twenty four subject to sale in the Montgomery land District together with and other forty acres due South of the above Describe land together with my Present crop Stock household and Kitchen furniture also one small waggon and all the farming utensils our horse and all other thing that may not be relocated by me To have and to hold so long as she may live and at her death the Said property to be Equally divided amongst all my children and I further will if my wife Elizabeth she may after my death that this my property shall not be subject to pay and debts made or to be made by the Second marriages But to be Keep in ? ? for my children given under my hand at my house the day and date above written Sealed with my seal Jordan Milam (SEAL) Witnesses: Johnson Hall (others not readable) Jordan Milam deceased estate of Probate Court order selling day September 29, 1863 William Brewer administrator of said estate having this day filed his applications, in writing and under oath, praying for an order and process to sell certain real estate is said petition discribes of the property of said decedent at the time of his death, or division, and ? the ground that the same cannot be equitably divided among the heirs at law of said estate without a sale thereof, And it appearing from an ? of said petition that as heirs of law said deceased an his children to wit: Mary A. Richardson, wife of David N. Richardson over twenty one years of age, and resides in Tallapoosa County, Thomas J. Milam over twenty one years and resides in this County, John Milam over twenty one years of age and resides in this county, Francis M. Milam over twenty one years of age and resides in this County but now in the Confederate army ; James W. Milam deceased and no administrator ? his estate; Sarah Seats a ? sale over tweny one years of age, William Milam over twenty one years of age and lives in Talladega County, but now in the Confederate Army; Willaby Milam over twenty one years of age & now in the Confederate Army; Martha A. Dumas deceased upon whose estate there is no administrator. It is therefore ordered adjudged and decreed, that the 3rd day of November 1863 be and it is hereby appoited a day for hearing the said applications, and the proof which may be submitted in support of our notice of the nature of said applications, and of the time shown set for hearing thereof be given at least forty days before the said day of hearing by publication in the Banner & Lives a newpaper publication in said County for three weeks, for all persons in interest to appear and contest said application if they think proper. It is further ordered that Mart A. Richardson and her husband David N. Richardson, Thomas J. Milam, John Milam, Sarah Seats, a ? sale, all have due notice of this proceeding and of the day set for hearing the same by citation to be personally served upon them at least two days before said 3rd day of November 1863. Before me, ALLEN D> STURDIVANT, Judge of Probate Court, in and for the County and State aforesaid personally appeard JP Oliver, publisher of the Banner & Lives, a weekly newspaper, published at Dadeville in said county and after being sworn, says that the annexed advertisement was published in said paper for 3 successive weeks, and that the first insertion was made in said paper on the 1st day of October 1863. JORDAN MILAM deceased estate of. This day came Wm. Brewer, Administrator, with the will annexed of said estate, and filed his application in due form and under oath praying for an order of sale of certain lands discribed therein, and belonging to said estate, for the purpose of division, and upon the ground that said lands cannot be equitably divided; It is ordered that the 3rd day of November, 1863, be appointed a day for hearing such application, at which time all parties in interest can appear and contest the same if they think proper.
