Al. Will Book 1 1838-1868 State of Alabama Tallapoosa County In the name of God Amen. I Abner Baker of the County and State Aforesaid knowing the certainty of death and the uncertainty of life, and being of sound mind and disposing memory, do make the following disposition of all my worldly matter and effects To Wit: Article 1st. I desire that my body may be decently buried. Article 2d. I request and require that all my just debts be paid. Article 3d. I give and bequeth to my daughter Pherebe Sworpe one hundred dollars, Also to my daughter Harriet Walker, one hundred dollars. Also to my son Ruben B. Baker one hundred and thirty dollars. Also to my son Casper H. Baker two hundred dollars. Also to my daughter Moriah A. Shepard two hundred dollars. Also to my daughter Mary S. Bickerstaff one hundred and fifty dollars. Also to my daughter Rebecca A. Plant two hundred and forty dollars. Also to my daughter Elizabeth P. Norton two hundred and forty dollars. Also to my daughter Barbara F. York two hundred and forty dollars. Also to my daughter Sophia B. Posey two hundred and fifty dollars. Also to my daughter Nancy E. Parris two hundred and forty dollars. Article 4th. The above legacies are designed and believed will make all my above children equal in amounts received and due them. Article 5th. I require and desire that my estate both real and personal mixed be kept together and all revenue arising from the same be kept accounted for as part and parcel of my estate by my Executor herinafter named, except so much as may be needed to support my wife Sarah Baker decently and comfortably. Article 6th. I require that after the death or marriage of my wife, that all my estate be sold on a credit of twelve months and the same be collected as soon after due as possible, and equally divided among my said children. That this my last will and testament be strictly observed and executed, I make the following explanation, as it has meaning and intent to will that should my wife Sarah Baker marry, then I require that my estate be sold and divided amoungst my said children, as provided in article sixth. The forgoing last will and testament of mine may be fully executed I hereby appoint, ordain and constitute my wife Sarah Baker and my son in law Robert G. Plant sole executors of this my last will and testament. Having full confidence and faith in the ability, justice and honesty of my executors, I hereby require, enjoin and decree that no forms, customs or statutes or any Court or Courts of this state shall require or force my executors to give security for the management of my said estate. In testimony whereof I have hereunto set my hand and affixed my seal this twelfth day of July one thousand eight hundred and fifty eight. Abner Baker Probate date was August 19, 1862 Witnesses were Ralph McMullan, Ferrill Feilder and James A. Burks. The first two swore to the signature in 1862.
