Moore & Co of the second part and William Robertson Trustee of the third part Witnesseth that whereas the party of the first is indebted to the party of the second part by a promissory note for Ninety 5/100 dollars, dated 27 December 1854 and due twelve months after date with interest, and whereas he is anxious to secure the party of the second part in the payment of said note now therefore in consideration of the premises and the sum of one dollar to him in hand paid the party of the first hath granted bargained sold and conveyed unto the party of the third part the following land situate in the county of Tuscaloosa and known as the south west quarter of the north west quarter of section five and the south east quarter of the north east quarter and the north east quarter of the south east quarter of section six all in township 20 range 11 west in trust nevertheless and upon this condition that if the party of the first part shall fail to pay said note at maturity then the party of the third part upon the request of the party of the second part shall proceed to sell said land ( at public sale to the highest bidder for cash after giving thirty days notice of the time and place of sale at three public places and shall apply the proceeds of said sale to the payment of said note and the balance if any after paying the cost of this deed he shall pay to the party of the first part in testimony whereof the said parties have hereunto set their hands and seals the day above written.
