I John S. Bealle of the State and County aforesaid being infirm in body but sound in mind and disposing memory and recollecting that life is uncertain and that it is appointed unto all must die, do make and ordain this my last will and testament in_____ and form as follows. Here revoking and omitting all former wills by me at any time made. Item 1: It is my will and desire that all my just debts be punctually paid. Item 2: I give and bequeath and devise to my beloved wife Ann H. Bealle during the time of her natural life all my property of every kind and description real/personal and mixed in possession and in action, situated in the State of Alabama near Mississippi and elsewhere. Item #3: I give and devise after the death of said wife to my daughter Ann S. King, my aforesaid____ of lands, embracing all that tract of land in which the family residence is situated and lying mostly on the West but partly East side of Grants Creek in the State and County aforesaid. Item 4: I give, bequeath and devise after the death of my said wife, to my grandchildren, the children of my daughter Martha J. Eddins and Ann S. King, and of my late son John R. Bealle, to be equally divided between said grandchildren share, and share alike, all my property of every kind not disposed of in item third of this will. Item 5: I hereby constitute and appoint my wife Ann H. Bealle and daughter Martha J. Eddins and M.A. King my executers and executors to compensate all force and effect of this will. Collier Foster D. L. Foster ---- W.R. Bealle The State of Alabama County of Tuscaloosa Probate Court June 18th 1870 In the matter of the Probate of the last will and testament of John S. Bealle deceased. Before me William Miller, judge of the said court personally appeared in open court J. Collier Foster, D.L. Foster, W. R. Bealle, who having been by me first respectively duly sworn and examined, did and do dispose and say an oath, that they are each subscribing witnesses to the instrument of writing, now shown to them, and which purport to be the last will and testament of John S. Bealle deceased late as inhabitant of this County that said Bealle since deceased, signed and executed said instrument in the day the same bears date, and declared the same to be his last will and testament and that official ____signature ____ on the day ____ bears date, as subscribing witnesses to the same in the presence of the said testator. That said testator was of sound mind and disposing memory, and in the opinion of _____ fully capable of making his will ______ the same was so made as aforesaid. ____ further state that said testator was on the day of the date of said will of the full age seventy one years and upwards. Bealle deceased and that said will together with said proof thereof has ben duly recorded in my office in Book of Wills No. Pages 18-19.
